New CAN-SPAM Rulings

Dear Subscriber,

Welcome to the new issue of Zinester's Publisher News!


On December 16th, 2004, the Federal Trade Commission announced their final decisions on how CAN-SPAM will be implemented and made the all-critical definition of what a "commercial message" really is.

We have read this 81 page document attentively and created the list of 5 most important things that every ezine publisher should accomplish to be CAN-SPAM compliant.
  1. Your messages should NOT contain false or misleading header, subject or 'From' line information. In addition, the Act prohibits sending a commercial email message without providing clear and conspicuous identification that the message is an advertisement or solicitation.

  2. It is required that your messages contain a functioning return email address or similar Internet-based mechanism for recipients to use to 'opt out' of receiving future commercial email messages.

  3. All unsubscription requests should be processed within 10 days. After this period neither you, nor other people acting on the your`s behalf can initiate a commercial email to recipients that have opted out.

  4. According to the law, the opt-out request is for any promotional mail your brand might ever send that email address from any list or staffer again. So not only have you to keep your own "Do NOT Email List" (the list of people who have ever asked to be removed) but also your affiliates should synchronize against it to be CAN-SPAM compliant.

  5. You should include your valid physical postal address in all of your commercial emails.
Any business that sends any emails to anyone with a commercial purpose must now be compliant with the CAN-SPAM act.

  1. We use clear RFC-compliant headers, including RFC List-Unsubscribe header which contains an unsubscribe link. Our headers identify accurately the computer used to initiate the message.

  2. Every message sent through Zinester contains a working one-click unsubscription link.

  3. By default our response email address is used in 'From' and 'Reply-To' lines of the newsletters. If you changed it to your own, then be sure to process all unsubscription requests in time.

  4. We look through all messages we receive and if the unsubscription request is sent, it is processed immediately - usually less than one business day (10 are required by the law).

  5. The suppression list is now available for all our publishers (not only for the Premium Members as it was before). You can choose to download it from the web or we can email reports to your email address - please contact us to have this option activated.
