Founder Denis Kitchen retired from the Board, and will be replaced as President by Chris Staros, publisher of Top Shelf Productions. Milton Griepp was elected as the organization's new Treasurer, succeeding Frank Mangiaracina. Peter David, John Davis, Neil Gaiman, Frank Mangiaracina, Greg Ketter, and Louise Nemschoff were also re-elected to serve another term on the Board of Directors. Kitchen's retirement from the Board marks the end of an era for the Fund, which he founded 18 years ago. "The challenges facing comics are different from when I founded the Fund," Kitchen said. "In the eighties, comics were still fighting for respectability and it was perhaps easier for them to be stigmatized as kid stuff. Two decades later, comics have attained a certain respectability, but are facing new sets of challenges. I think it's fitting that the generation directly facing these challenges, led by Chris Staros, a publisher after my own heart, should be the ones standing up to them." Chris Staros recalls, "Back in '97 I wrote Denis Kitchen to tell him that 'one day, when I've earned my place in comics, I'd love to serve on the CBLDF Board of Directors,' as I've always believed in the absolute importance of its mission. For two years I've had the pleasure of serving on the Board under Denis, and have witnessed first hand what an amazing asset he's been in defending the First Amendment rights of our industry. It'll be tough to fill the shoes of the founder of the Fund, but I'm honored to take over as President, and look forward to working with the entire community in this role." Milton Griepp's election as Treasurer was received as good news by Kitchen who said, "I'm delighted that Milton is the organization's new Treasurer. He brings a particular corporate expertise and extensive experience in non-profit fiscal management that I'm certain will help the Fund grow even stronger in the future." Kitchen adds, "I look forward to continuing my support of the Fund from the other side of the table. I feel that I'm leaving the organization in good hands, with an active Board under the leadership of Chris and Milton, and a strong office under the management of Charles Brownstein. I'm confident that the Fund can only become stronger as it confronts the challenges on the horizon." ******************************** A Personal Message from Chris Staros: Hello, everyone. Thank you so much for the warm reception. I've received dozens of heart-felt and congratulatory emails since the above announcement was released by the CBLDF. It's nice to be in such a supportive community, and I look forward to working with all of you in the coming months. You know, comics is the last truly free artistic medium. Yet the fact that it's relatively small makes it extremely vulnerable to politicians and prosecutors trying to make names for themselves on the often-overzealous moral ground of "protecting the children." It is here that First Amendment battle lines are drawn and precedent setting cases are determined, and that's why it's critical that all of us -- publishers, distributors, retailers, creators, and fans alike -- support the CBLDF in any way that we can. It may surprise you to learn that there are currently only 1,300 members of the CBLDF. In an industry of over 3,000 retailers and at least 5,000 professionals -- the most likely to be defended by the Fund -- as well as over 250,000 fans, there are only 1,300 people who feel strong enough to become "card carrying" members of the CBLDF. We're fortunate enough to live in a stable country, which gives us the "luxury" of becoming complacent about political matters. But in a post 9/11 environment, when the battle for our civil liberties is being fought at all levels, this is not the time to sit on the sidelines. I've personally witnessed -- as Top Shelf -- what this community is capable of when it rallies behind a cause. And the CBLDF is a cause worth rallying for. In his acceptance speech for the CBLDF's Defender of Liberty Award at this year's Eisner ceremony, Jim Lee eloquently stated "You certainly don't need the likes of me to tell you what dangers we face as an industry and as a community: dangers from overzealous local prosecutors looking for easy, under-funded targets for political gain; dangers from a federal government using an environment of fear and uncertainty to weaken our civil rights. ... We live in a scary time -- a time when the power of the First Amendment is truly being tested and it is my honor to be able to help in any way possible. But we need your involvement as well. Every professional, every retailer, every fan here should be a member of the CBLDF." And in Chuck Rozanski's Defender of Liberty acceptance speech from the previous year he impassionedly expressed, "One of the things that's come up lately is the concept that patriotism involves repression. I think that in this country -- my adopted country -- that patriotism, true patriotism, involves defending the rights that the people who came before us fought and died to achieve. ... we owe it to the next generation to not leave them a world which has greater repression and less freedom than the world we were given. So I ask you all to support the CBLDF in any way that you can." When pillars of the community voice articulate and emotional pleas like this, there is no excuse not to take action. Savage Dragon mounts presidential bid this November. Erik Larsen's Savage Dragon has done a lot of things over the course of 115 issues, but one thing he's never done is run for public office. Until now. As the presidential election heads to the wire, Dragon finds himself thrust onto the campaign trail with vice presidential hopeful Ronald Winston Urass. While the seeds of the storyline are planted with SAVAGE DRAGON #116 (available in August), Dragon's run to the White House begin in earnest with SAVAGE DRAGON #119, available just in time for the election this November. SAVAGE DRAGON creator Erik Larsen outlines the political game plan for Dragon. "Ronald Winston Urass is a wealthy man and his wealth is the key ingredient needed for a successful run for the White House. But this isn't at simple as you might think. "The event really needs to be on a Saturday, so that people can spend their 24 hours and still have time to recover before work or school on Monday," explains Gertler. "Because of that, we couldn't keep the April 24th date we used for this year's inaugural event. But by having the 24 hours starting on the twenty-third, it actually ends on the 24th." Once again, comic book stores, comic clubs, and educational institutions will be hosting 24 Hour Comics Day events where cartoonists will work side by side in a spirit of camaraderie. "The early indications are that most but not all of the locations that hosted events this year will do it again next time, and there's a fair number of additional retailers showing interest. Between that and the on-going enthusiasm from both amateur and professional cartoonists, it looks like 2005 will be even bigger than 2004," says Gertler. Announcement of the initial list of event locations is still months away. In other 24-hour-comics-related news: Sponsors for 24 Hour Comics Day are being sought. "We're not looking for money," explains Gertler, "but for products that will make the day more enjoyable for those participating at event sites. Snacks, meals, soft drinks, energy drinks, art supplies, and photocopying services are the obvious examples." Numerous rumors have been flying of late regarding Superman, Superboy and the copyrights to these world famous characters, including whispers that the heirs of creators Jerry Siegel and Joe Shuster have regained the rights to the characters. While the rights appear to be caught in legal limbo, according to paperwork filed at the Library of Congress, in November 2002, Joanne Siegel and Laura Siegel Larson filed to terminate the assignment of Superboy's copyright to Time Warner, The Beat has learned. The termination becomes effective on November 17, 2004. In addition, Mark Peary, the executor to Joe Shuster's estate, has filed a copyright assignment termination notice for Superman, effective October 26, 2013. As well documented, Siegel and Shuster sold all rights to Superman to National Periodicals in 1938 for $130. Within just a few years, the character had become a sensation, with a radio drama and movie serial in addition to the comic. In 1947, while the character remained enormously profitable, the duo were getting less and less work, and sued DC (as the company was then known) to regain the rights to Superman. Although the judge ruled in favor of DC, he assigned the rights to Superboy - a separate character who had recently been introduced in the pages of MORE FUN COMICS - to Siegel and Shuster, citing the fact that the editorially created character was an unfair infringement on their original copyright. According to Gerard Jones' upcoming history of the period MEN OF TOMORROW, Siegel and Shuster, devastated by the loss of the Superman suit and fearing DC's legal might, settled by selling the rights to Superboy back to DC for $100,000. In addition, so bad were feelings surrounding the lawsuit that their names were removed from the credits. Siegel and Shuster continued to struggle financially for the next 20 years, with Siegel trying yet another unsuccessful legal bid to regain copyright to Superman in 1966. In the 70s, with the first Christopher Reeve Superman film coming out, and both men living on welfare, a grassroots campaign spearheaded by Neal Adams began to get the pair some recognition. Thanks to the efforts of a more sympathetic regime at DC, Siegel and Shuster's names were restored to Superman's credits and they were given a modest pension. Cut to more recent history. In 1998, Joanne Siegel and Laura Siegel Larson (widow and daughter of Jerome, respectively) filed to terminate the copyright assignment of Superman to DC. Termination of copyright is part of the 1978 Copyright Act, specifically Section 304 (c), and was created to protect the rights of authors who had made disadvantageous deals. Basically, the law states that authors or their heirs have a five year window to file for the termination of copyright assignment starting 35 years from the assignment. (Superman's creation does not fall under work-for-hire, as all courts have agreed that Siegel and Shuster came up with the character independently. It's the original 1938 sale which has been upheld all these years. However, this still means that it was originally their copyright to assign, hence the potential ability to terminate the agreement.) Legally speaking, if the Siegels' copyright termination to Superman were upheld, they would be entitled to 50% of all the profits of Superman since the revocation took effect on April 16, 1999. Since the filing was made public, little has been reported about negotiations, which are ongoing. Time Warner is understandably less then eager to give up half the rights and profits to one of their most recognizable characters, who is even now being readied for a return to the big screen under director Bryan Singer. Should the copyright termination stand, the Siegel family would be entitled to a huge chunk of the profits from the upcoming movie. While the Superman claim remains mired in legal red tape, the Superboy claim appears to be a bit more clear cut - Siegel and Shuster were granted ownership of the character in the 1947 decision, and their subsequent sale of the character to DC would come under the jurisdiction of Section 304 of the copyright law. For everyone who has a headache after all this legal talk, the question may be, what's the bottom line: well, here's one word for you: SMALLVILLE, an enormously successful show about a young Clark Kent, who is about to become Superboy. Should the copyright termination stand, DC could be forced to make a very large payment to the Siegel family. The story of Siegel and Shuster and how they sold away a multi- million dollar character for pennies remains almost as mythic as the superman they created. Their tale informs the Pulitzer Prize winning THE ADVENTURES OF CAVALIER AND CLAY, and several comics stories, including Rick Veitch's THE MAXIMORTAL. Indeed, so notorious is the story that it is often cited in discussions of copyright law. Thanks to that same law, as arcane as it may be to the layman, it's possible that the heirs of Siegel and Shuster have one more chance to regain the characters they have been fighting for for over 50 years. +++++ From the Comics Continuum at http://www.comicscontinuum.com/: SMALLVILLE UPDATE Michael Ironside is playing General Sam Lane in The WB's Smallville, The Continuum has learned. The general, of course, is the father of Lois Lane, played by Erica Durance for 13 episodes of the fourth season. "You get to see that father-daughter dynamic played out, which is something we haven't really done on the show before," executive producer Al Gough said during the recent Smallville panel at Comic-Con International. "We've had a lot of fathers and sons, but never any fathers and daughters." Ironside, 54, has more than 125 film and television credits. He is no stranger to the DC Comics Universe, having performed the voice of Darkseid in both the Superman and Justice League animated series. In other Smallville news: At Comic-Con, DC Comics passed out a postcard featuring the show's debut on ABC Family this fall. The Wednesday, Aug. 18 episodes on The WB will be "Delete" and "Velocity."
