Garth Ennis Takes Aim with 303 from Avatar Press

Avatar Press has announced that it will publish Garth Ennis' 303,
a six-issue full color mini-series written by Preacher creator and
Punisher writer Garth Ennis and drawn by Jacen Burrows (Warren
Ellis' Scars, Alan Moore's The Courtyard).  The eagerly-
anticipated saga is scheduled to begin in October.  Preview pages
from the first two issues are available now at
www.garthennis303.com.

"303 is the story of a Russian Special Forces Colonel, who, after
a particularly brutal bit of black ops nastiness in Afghanistan,
decides to walk to America to take out a highly important target,"
explains creator Garth Ennis.

"The title refers to the rifle he's going to use for the job, an
antique British army Lee Enfield, three oh three calibre. This was
the weapon that took the British army through two world wars and
survived in its service until long after the second.  It still
shows up today from time to time, carried by tribesmen and
guerrilla fighters in some of the world's most brutal conflicts.
The Lee Enfield is one of the great success stories of killing
technology; it's simple to use, what flaws it possesses are few
and far between, and it'll withstand a good deal of very rough
treatment indeed before it stops doing what it says on the tin."

"This particular Lee Enfield, however, is not just some artifact
long overdue for retirement. High in the war-ravaged mountains of
Afghanistan, the rifle falls into the hands of a man who plans to
do the unthinkable: who sets out on a journey across whole
continents, who fights his way through killing grounds both
terrible and unexpected, all so he can fire a single bullet at the
most important target in the world.

"303 begins as a war story, but changes halfway through into
something I'm still not certain of myself," adds Ennis. "This is
odd territory we're traversing, where the past pushes its warriors
into the present with murderous intent, aiding and abetting
destiny by means of numerous unwitting agents.  It's the tale of a
soldier who's been fighting for nothing all his life, but now
believes he's found his purpose, and the one man who can stop him,
a worn-out hero filled with fatal sadness."

"If I had to sum it up in one line, I'd say 303 was inspired by my
fears for the world," Ennis says.

"I'm extremely fortunate to have the excellent Jacen Burrows
drawing the story for me," notes Ennis. "If you've enjoyed his
work with Alan Moore and Warren Ellis, you'll know exactly what I
mean. Jacen's producing some of his finest work to date on this
book, and with the complete creative freedom available at Avatar
Press, you'll be glad to hear that neither he nor I will have to
pull our punches. Which comes in handy, believe me, when you
realize that a story's taking you places you've never been
before."

Garth Ennis' 303 begins in October 2004 from Avatar Press, and is
available for order now from comics retailers everywhere.  The
full color saga is written by Garth Ennis and drawn by Jacen
Burrows, with color by Greg Waller.  For more information, email
info@avatarpress.net or see the 303 website at

BLOODRAYNE Fights Her Way into Comics, Just After New Game
Release!

August 12, 2004 -- Starting in December, Echo 3 Worldwide and
Digital Webbing will bring Majesco's BLOODRAYNE to comics.  Timed
to be published just after the release of the BLOODRAYNE 2
videogame, the BLOODRAYNE comics will be published as a series of
full-color quarterly one-shots.

"We're very excited to have acquired the exclusive BloodRayne
comic book rights," said Steven O'Connell, President of Echo 3
Worldwide and co-writer of the comic.

Adding to the excitement surrounding the release of the comic is
the recent announcement of the BLOODRAYNE feature film, starring
Kristanna Loken from "Terminator 3: Rise of the Machines," which
earned the comic a mention on MTV News.

"BLOODRAYNE has built a loyal following of fans and established
herself as a new breed of action heroine," said Ken Gold, vice
president of Marketing for Majesco. "With a movie announced, and
now a comic book, we're thrilled to see our franchise expand into
other entertainment mediums."

The character of BloodRayne is a female dhampir, born from the
unnatural union of vampire and human. Raised and trained to hunt
supernatural evil, Rayne is blessed with the powers of a vampire,
but cursed with an unquenchable thirst for blood and a weakness
to sunlight.

"The character has so much untapped potential," raves O'Connell.
"A female half-vampire with a nice set of blades, cutting up dark
nasties - what's not to love?   BLOODRAYNE is so visual and as
long as we offer great writing to back up the great visuals, it's
a no-brainer!"

Although appearing two months after the sequel game hits the
market, the first issue of the BLOODRAYNE comic will feature an
original tale.  "We take Rayne and plunk her down into a non-
fiction setting.  I don't want to spoil the surprise, but it's a
great tale that takes place between missions in the first game."

The first one-shot showcases the penciling talent of Romano
Molenaar, former artist of PURGATORI, LADY DEATH, THE DARKNESS,
and WITCHBLADE.  Inking Moelenaar's linework is Marco Galli, inker
of several Top Cow books.   Colors will be supplied by Blond,
colorist of GHOSTBUSTERS and MASTERS OF THE UNIVERSE. Writer
O'Connell's credits include the independent comedy film, "Rock
Bottom" and TIGER WRAITH, published by Mammoth Press.  Co- writer
Jeffery Stevenson is a founder of the writing resource site,
Scryptic Studios, a writer for Studio ICE, and the creator of the
online strip "Brat-halla."

More information about Majesco's BloodRayne 2 can be found online
at www.bloodrayne2.com.  Echo 3 Worldwide can be found on the web
at www.echo3worldwide.com.

BloodRayne: Skies Afire #1 one-shot can be found in the October
Diamond Previews for items shipping in December.

Sam Vincent is providing Krypto's voice, and Alberto Ghisi is

Bros. Animation provides us a powerful partner to help build this
new franchise into a joyful, meaningful experience for these young
viewers."

All of the series will be developed in collaboration with a Child

BERRY X-ITS X-MEN 3

Despite the mauling that Halle Berry's Catwoman movie has received
from critics in the U.S., with USA Today saying it "belongs in the
litter box" and the New York Post describing it as "about as sexy
as a hairball", the actress has not only announced her desire to
reprise the role of Patience Price in a Catwoman sequel, but she
has also backed out of two more planned X-Men movie sequels.

According to Star magazine, Berry's decision was based on a
combination of screen time, money, and the dominant story line
demands in the upcoming X3.

"If Halle was going to be in the sequels, she wanted the focus of
the films to be on her," a source was quoted as saying. "She
priced herself right out."

The news follows the recent announcement that X-Men movie makers
20th Century Fox have dropped director Bryan Singer following his
decision to revive the Superman film franchise for Warner Bros.

CLASS IS IN SESSION THIS NOVEMBER FOR THE INTIMATES!
August 10th, 2004 -

Brace yourselves for THE INTIMATES, one of WildStorm's most hotly
anticipated new series of 2004! The action hits this November as
writer Joe Casey teams with penciller Giuseppe Camuncoli and inker
Sandra Hope, with additional art by superstar Jim Lee, who also
provides covers! THE INTIMATES is co-created by Lee & Joe Casey,
with character designs by Lee.

"This is the first project I've co-created since WildStorm became
a part of DC six years ago," says Lee. "It's really been fun to
flex thoses muscles again. Giuseppe Camuncoli - Cammo, to his
friends - has this amazing blend of Paul Smith and Frank Quitely,
and I think he's going to be the next big thing. The fans are
going to be very excited when the book comes out!"

THE INTIMATES takes readers to the Seminary, a training school
where super-powered teens learn how to be heroes. The series
follows the misadventures of new students Punchy, Destra, the
Duke, Empty Vee and Sykes as they cope with a curriculum that
includes Secret Identity 101, NuPhysics and even Morality Class.
But things aren't what they seem at the mysterious Seminary, the
home of a dark secret even the retired super-hero faculty may be
unaware of. Though they may not realize it, these kids are the
future of the WildStorm Universe...but right now, they're just
late for gym class!

"This book has been a labor of love for everyone who's been
slaving away at it for the past year," says Casey. "Teen super-
hero angst has never looked this good. My creative collaborators
are the absolute best in the biz! Seeing what we've come up with,
from concept to characters, I think THE INTIMATES has something
for everyone: something old, something new, something borrowed,
and something in technicolor-neon-electric blue."

Comic Retailers Get Marvel Settlement Package
Detailing Proposed Credits, Options
 August 09, 2004
Comic retailers began receiving the Marvel settlement packages in
the Brian Hibbs class action suit last week. The packages detailed
the provisions of the proposed settlement and the specifics as
they applied to the individual retailers. The terms were as has
been previously publicized: 24% credit on late books, 17.5% credit
on books with content different than what was solicited.

Retailers now have 45 days to respond, either to accept the
proposal, provide documentation that the calculations in any
individual case were incorrect, or to reject it. Marvel has the
right to terminate the settlement agreement if over 10% of
affected retailers or retailers representing over $250,000 in
proposed credits reject the settlement.

The documents also detail the legal fees, which under the proposed
settlement Marvel will pay directly to the attorneys representing
Hibbs and the class. An amount of up to $375,000, plus expenses,
is incorporated into the settlement. The actual final amount will
equal the attorneys' hourly rate times 1.6 or 24.2% of the value
of the settlement. The multiple of the hourly rate is given
because the attorneys took the case on contingency, meaning they
would have received nothing if the case was not settled or won.

We examined the specific calculations applying to one retailer. In
his case, the gross order amount of the books Marvel delivered
late totaled $8,197,59. Those orders ranged from 200 copies of
Origin #4 down to single copies of a number of books, including
Marvel Knights Magazine #5. Our sample retailer also received
$31.82 worth of books that were delivered late only to some
retailers. He had previously returned $185.85 worth of late books.
Accordingly, the calculation in his case provided for credit of
$1,931.17, or 24% of the net late books.

Our sample retailer had also received $655.53 worth of books that
arrived with different contents than those solicited. He is
eligible for $114.72 in credit for those books, or 17.5% of the
total. The total credit for our sample retailer will thus total
$2,045.89, if he accepts the settlement and it clears the other
remaining hurdles to approval by the court.

Based on the timing in the documents, it appears that retailers
will have until around October 1st (depending on when each
retailer received his documents) to respond. Marvel then has 30
days to tabulate the results to make sure that the required
threshold of retailers accepting the deal has been reached. We
would assume that since this represents found money for most
retailers, and the percentages appear reasonable, they will accept
the proposed settlement.

The next hearing in the case is scheduled for November 4th. After
the hearing and (presumed) court approval of the settlement
agreement, a 30-day waiting period for appeals will be observed.
After that period has elapsed, credits will be issued. So it looks
like this case could be wrapped up and credits issued before the
end of the year. This represents a period of around 2.5 years from
the initial filing, a fairly expeditious resolution of a class
action suit.

Simpsons Hits #100
Second Crossover With Futurama Coming
 August 10, 2004
Bongo Comics has announced that Simpsons Comics #100, due out in
November, will be a special 100-page, $6.99, prestige format issue
and the first "clip-show" comic ever. The storyline includes
flashbacks, as Bart discovers he and other Springfield residents
have been in 100 comic books and tries to find every issue.
Although some of the flashbacks are "memories" from prior issues,
some are brand new. Over-all, the issue is about 1/2 new
material.

Bongo's Terry Delegeane told ICv2 that Simpsons Comics #100 will
answer the age old question of "Whatever happened to the comic
book collection that Mom threw out?" This issue will also include
two pages of art by Sergio Aragones, along with an appearance by
the artist.

Bongo also plans to release the second Simpsons/Futurama
crossover, as yet untitled, as a two-issue series in January and
March of 2005. This miniseries follows the fictional characters as
they are enslaved and then come to life.

In September, Bongo will publish Bart Simpson's Treehouse of
Horror, cover-priced at $4.99, featuring guest writers Gene
Simmons of Kiss, Alice Cooper, Rob Zombie and Pat Boone.

Marvel To Move Book Distribution To Diamond From CDS
 August 10, 2004
Multiple sources told ICv2 late Monday that Marvel is about to
announce that it is moving its book distribution from Client
Distribution Services to Diamond Book Distributors. The move would
be a return for Marvel, which left Diamond two years ago for CDS.

The move will put two of the largest graphic novel publishers,
Dark Horse and Marvel, at Diamond, and one each at CDS (Tokyopop),
Simon and Schuster (Viz), and Warners (DC). Diamond has been
aggressively building its book trade distribution operation since
it formed its new division a little over three years ago. It also
has a large number of medium and smaller graphic novel publishers
as book distribution clients.

Marvel Reprints Astonishing X-Men 1-3 As Must-Have
 August 10, 2004
Marvel has announced that it is publishing a Mighty Marvel Must
Have collecting Astonishing X-Men 1-3, with an August 25 street
date. MSRP will be $5.99. The August 25 street date is the same as
the street date for Astonishing X-Men #4.

All three issues have sold out from the publisher, some in big
numbers. Astonishing X-Men #1, for example, sold over 209,000
copies in May
