+++++ From Darren Kane at Marvel Comics http://www.marvel.com POPULAR MUTANT TEENS RETURN TO THE STREETS! FAN-FAVORITE NYX TO BE COMPLETED AFTER LONG HIATUS! NYX, the popular mutant series from Marvel Comics, will finally be completed after an extended break in publication. Fans hungry for new issues of the title have only to wait until July of 2005 for issue #6 and August for #7. Reviews for the first several issues of NYX have been decidedly positive. Comic Buyer's Guide has said that Marvel has "a solid hit on its hands" and that "character development is the key" to its success. SilverBulletComicBooks.com notes that "every character sounded real" and also that NYX is "a good story about realistic teens". NYX details life on the streets of the Big Apple through the eyes of a band of teenagers. These are not your average teens though, but kids with some very special abilities and, yes, some regrettably all-too-common problems. NYX's violence and pathos is portrayed in a frank, street-level manner, with a dash of mutant mayhem adding to the local color. It also introduced its first breakout character in the form of X-23, the mutant clone of the X-Men's Wolverine. X-23 has gone on to be featured prominently in the sold-out Uncanny X-Men #450-#451 and in her own miniseries, which is also selling out. Series scribe Joe Quesada, also Marvel's high-flying Editor-in- Chief, is more than proud of the book and its ability to induce passionate talk on Internet message boards. "Like my art, writing has become near and dear to me," says Quesada. "That makes it very sad for me when circumstances pile up and cause delays in getting the stories out. I take full responsibility and hope fans will still be excited to get new issues." Quesada says he has closely monitored the reviews of the initial issues. "The kick I get from feedback on the book is indescribable. My challenge on NYX is to take Stan Lee and Jack Kirby's basic concept, teens with mutant powers, and present it with today's sensibilities and in a realistic locale. If readers see something of themselves in Kiden & Tatiana and feel that it's a New York that breathes real life, then I feel like I've done my job." he adds. "The characters in this book have come to life for me, and I hope for the fans, too." Editors MacKenzie Cadenhead and C.B. Cebulski are elated at the completion of NYX, and are also forthright about some of the difficulties of the book's production. "We're happy to see NYX finally get back on track," reports Cebulski. "Yes, the publishing schedule on this book has been a little erratic, and for that we do offer the fans our sincere apologies." The duo's energy level is also high for what the near future brings. "Joe's scripts are amazing and (artist) Rob Teranishi has really hit his stride on these characters. Kiden, X-23, Tatiana and the gang really make an impact on the Marvel Universe that no one saw coming." Retailers are also happy with the strong sales on NYX and are full anticipation mode for the new issues to hit their shelves. "Many fans got hooked on this distinct Marvel series," comments Brad Taylor of Fantastic Family Comics in Sunland, CA. "Its all too short initial run introduced some great new folks to the House of Ideas and its great to hear that more is on the way." Taylor also notes that the book doesn't get lost on his stands among the many other titles. "NYX has it's own voice in a sometimes crowded mutant and teen market, but with the promise of new issues and new adventures I expect to be seeing a whole new 'X' in my top selling books." NYX will also be joining the ranks of the House of Ideas 'Marvel Must Haves' reprint line, giving a second chance to readers who's interest may have been piqued but missed out on the initial first printings. May of 2005 will bring NYX Must Have 1-3 and NYX Must Have 4-5 (with a few extra goodies) hits the shops in June. If that wasn't enough in itself, October of 2005 will see the publication of a special oversized hardcover that combines issues of NYX with its companion series X-23. Legendary artist Mark Silvestri will once again be drawing the mutant that drove him to the top -- in the form of the variant cover to WOLVERINE #26! WOLVERINE has been on a blistering pace, since writer Mark Millar took the reins of the title with issue #20. Now onto his second arc with the six-part "AGENT OF S.H.I.E.L.D.", Millar's issue #26 has Wolverine in S.H.I.E.L.D. custody, Hydra celebrating the coronation of a new leader, The Hand picking off the meta-humans one by one, and the secret origin of the Gorgon! The books seized had been throw-ins in a shipment from Stripburger to the publisher Top Shelf Comics. Top Shelf was informed of the seizure in a letter they received October 7. In November, following a unanimous vote from the board from which Fund Board President and Top Shelf Co-Owner Staros recused himself, the Fund hired Charleston Attorney Gregg Meyers to challenge the ruling. On January 24, Meyers had word that U.S. Customs would release the books and refund the $250 paid to file the objection. This information was released to the Fund on the 25th. The final documents from U.S. Customs were received by Meyers on January 31. The Fund then finished its initial thoughts on the matter via press release, which were distributed to board members and affected parties on the afternoon of the 3rd and subsequently released to press sources on the evening of February 3 for February 4 distribution. "I am very pleased this case was resolved without the legal battle costs," artist Peter Kuper wrote to the Pulse via e-mail on the morning of February 4. "Also, perhaps by avoiding the legal wrangling, customs will have extra time to keep their eye on incoming shipments that contain something slightly more threatening than comics (say, a bomb, for example). It's also nice to know that parody can still exist in this country, given how much it's needed during these stressful times." A Mad Magazine artist in addition to pursuing illustration and graphic novel work, Kuper added, "I would also like to thank customs for providing me with an idea for my next Spy Vs. Spy strip." For its part, the CBLDF felt relieved that the matter was resolved without further legal action being taken. Executive Director Charles Brownstein, in the group's official statement: "It's exactly the kind of victory we want, where reason prevails and no one has to go to court. It's always better to prevent a trial than defend a trial, and I'm pleased that the government felt the same way in this case and returned the materials that were wrongfully seized." The books seized were worth approximately $400, a not- insignificant sum to a small publisher but certainly nothing compared to what legal costs could have become if U.S. Customs had been willing to go to court. In their press release, CBLDF President Chris Staros indicated that the principle of the issue involved - which he termed "that of Customs overreaching its authority to judge what is parody and what is not" was definitely worth the Fund pursuing the matter. Although the Fund won on principle, because U.S. Customs withdrew on the matter the government agency would still have the right to make similar seizures in the future. "Because it didn't go to court, no legal precedent was set," Brownstein told the Pulse. "So I have no basis to think this kind of thing won't happen again, because there's no case law warranting that it will or won't." What Brownstein has, he said, "is the sense that because this happened once and because we expressed a willingness to fight it, Customs will think twice before doing that again." Unlike legal statutes that the CBLDF encounters where the law itself is challenged, what was at issue in South Carolina case from the Fund's point of view was misuse of a US Customs regulation that could potentially have beneficial applications stopping actual piratical or bootlegged art. Not only is pursuing changes to that kind of authority beyond the purview of the Fund - "it's against our power to bring prosecutorial action" - Brownstein admitted that the Fund would have little to say in a case where Customs seized material that was not satire; in fact, they would support such actions to protect the rights of the copyright holder. Brownstein is very clear that not only would the Fund protect all satirical uses from such a misguided action but the Kuper and Redzic cartoons were clearly and overwhelmingly comics of the protected type. "I think they got their wires crossed and didn't distinguish properly between protected speech and piracy," said Brownstein of U.S. Customs. The Fund does plan to further investigate the regulation in question for informational purposes. Attorney Meyers donated his time to the case, making any cost of the whole affair extremely nominal, Brownstein indicated. +++++ From the Comics Continuum at http://www.comicscontinuum.com/: CONSTANTINE MOVIE UPDATE * Constantine star Keanu Reeves didn't rule out the possibility of returning to the character. "My contract didn't have a second film in it," Reeves said during a news conference on Sunday. "But myself and some of the producers and Francis Lawrence fell in love with the guy. I fell in love with the guy. I had one of the best times I've ever had working on this project. So we would talk about 'What could we do?'" Reeves said that a sequel ultimate is up to the audience. "That would mean that the studio would have the resources to go forward with it," he said. "I would love to play Constantine again as long as I worked with the same people." * DC Comics and Vertigo are given equal weight to Warner Bros. and Village Roadshow Pictures in the opening titles. * The film has a short scene after the closing credits, which reveals what happens to one of the primary characters. * Shia LaBeouf, who plays Chas, will be a guest on NBC's The Tonight Show with Jay Leno on Wednesday, Feb. 9. * Gavin Rossdale, who plays Balthazar, will be a guest on NBC's Late Night with Conan O'Brien on Friday, Feb. 18, the day of the film's opening. SUPERMAN MOVIE CASTING According to The Hollywood Reporter, Sam Huntington has been cast as Jimmy Olsen in Bryan Singer's Superman movie. Huntington, 22, joins a cast that includes Brandon Routh as Clark Kent/Superman, Kevin Spacey as Lex Luthor, Hugh Laurie as Daily Planet editor-in-chief Perry White and James Marsden as Perry's son, Richard White. Kate Bosworth is in negotiations to play Lois Lane. Huntington's film credits include Jungle 2 Jungle, Detroit Rock City, Not Another Teen Movie and Rolling Kansas. He next will be seen in Molding Clay and Safety Glass. He recently has played Connor Mulcahy on CBS' CSI: NY. The Futon Critic reports that in addition to ABC Family repeats, Smallville has been cleared for off-network syndication starting in Fall 2005. Usually these broadcast repeats air on local stations on weekends. NEWSFLASH! A scooper at Superhero Hype! reports that, "I was at the FX Show this weekend, and spent some time talking to JK Simmons. According to him, they start hooting Spider-Man 3 in three months, and release date is Spring 2007. Course, things may change, but this is what the man said!" NEWSFLASH! Superhero Hype! caught up with Alan Cumming at the press day for Son of the Mask, who gave a bit of an update on X- Men 3. "I signed for two films, so I'm going to," Cumming said. "The last I heard is that we're starting on the 20th of June, but they don't have a script or a director yet so that may be pushed a little bit. But they have to release it in May of 2006 for some reason so it's gonna be shot in the summer." Cumming said that he is not disappointed with director Bryan Singer's departure, saying, "No. I'm not disappointed; I cannot deny that. I think he's really talented and I'm very proud of the film and I think it's a great film. I didn't enjoy working with him on the film." NEWSFLASH! Sony Pictures has launched the official Website for MirrorMask, written by Neil Gaiman, directed by Dave McKean, and produced by Jim Henson Productions. The site includes the trailer for the film, photos, downloads, promotions, and a Synopsis. The film premiered this past week at the Sundance Film Festival. NEWSFLASH! Zap2it has posted a new interview with Constantine stars Rachel Weisz and Keanu Reeves. In the interview Reeves spoke of a sequel to the film, saying, "Ultimately, it is up to the audience." He said that he connected so well with director Francis Lawrence that he wouldn't do a sequel without him. "I had one of the best times that I've ever had working on a film, working on this particular project." Reeves isn't contracted for a second film. NEWSFLASH! Watchmen director Paul Greengrass was recently interviewed on the BBC radio show Mark Kermode's Film Reviews. The interview starts around 27 minutes into the 34 minute show. Greengrass said he would be working on the film for about 18 months. "I'm excited," Greengrass said. "I mean, I agree it is the greatest comic graphic novel ever written. It was political, dark, conspiratorial, with something really important to say about the world, as well as being a fantastic comic book ride." Greengrass said that the film is in prep now, and said it would be a couple of months before we'll hear anything about casting. "It's an ensemble film, and you can't recast it part by part, you've got to cast them all until they're all in place... We've got eight people then I can say." He also said that the film has a massive scale, and the first big issue is sets. He said there will be six months of construction for the sets. Greengrass also joked that one big challenge is Dr. Manhattan, a 100-foot naked blue man, and translating him to the screen. COMIX-FAN NEWS BRIEFS - FEBRUARY 2, 2005 NEWSFLASH! Fox Home Entertainment has officially announced that Elektra will be released on DVD on April 5, in Widescreen, with an SRP of $29.95. Extras will include three deleted scenes (running about five minutes in total), a thirteen minute making- of Elektra featurette, a Comic-Con Presentation, an Inside the Editing Room feature, and both the theatrical and teaser trailer. The DVD will also include a soundtrack promo and an Inside Look at the Fantastic Four and Mr. & Mrs. Smith. Fox has yet to release the official package artwork. NEWSFLASH! The recently reported DVD for the 1966 animated series The Marvel Superheroes has been pulled off of Buena Vista's release schedule, TVShowsOnDVD.com reports. However, Buena Vista has told TVShowsOnDVD.com that they will instead release a multi- disc DVD box set of The Fantastic Four to tie in with the July 1st release of the Fantastic Four movie. The release will almost certainly be the 1994 Fantastic Four series, which lasted for two seasons, with thirteen episodes per season. The site reports that the formal announcement will be in just a few weeks. TVShowsOnDVD.com also reports that Buena Vista has informed them that the DVD of Spider-Man - The Venom Saga, the latest release of the 1994 animated Spider-Man series, is back on schedule. The title is planned for a Summer 2005 release, possibly in June, and the formal announcement is expected in a few weeks as well. NEWSFLASH! Warner Home Video has announced the Teen Titans - Vol 2: Switched DVD will be released on April 12. Vol 1, released last September, contained the first 6 episodes of the first season, and Vol 2 will contain the other 7 episodes of the first season. Extras will include Bonus "Toon Topia" webisodes, bonus trailers, and female group Puffy Ami Yumi sing and get interviewed regarding their Teen Titans theme song. SRP is $19.97, and running time is 151 minutes. TVShowsOnDVD.com has a look at the cover art for the DVD. NEWSFLASH! The WB and Verizon Wireless have teamed for a new Smallville contest. Fans must watch the new episode airing on February 23 to get Lex's password, then send the password as a text message from a Verizon Wireless mobile phone. Sam Raimi confirmed to Now Playing Magazine that a villain for Spider-Man 3 has been settled on, though he was careful not to reveal who. Raimi said that Alvin Sargent is writing the screenplay right now, and that Sony Pictures will release the identity of the villain in conjunction with Marvel Comics when they decide to do so. "Absolutely we wanted to have a villain not only who would fulfill the character needs but somebody who could entertain the audience on a visceral level and provide great visuals, something we haven't seen before, and create a real challenge and great foe for Spider-Man and his unique, spidery, spider-like powers," Raimi said. Raimi also talked with the Ohio newspaper the Aktron Beacon Journal (free registration required), briefly mentioning the Spider-Man franchise, saying, "I'd probably make as many Spider- Man movies as they would ask me." NEWSFLASH! Another scooper at Superhero Hype! attended the FX Show over the weekend in Florida and talked with J.K. Simmons about Spider-Man 3. The scooper reports, "I was also at the FX Show and when I spoke to JK Simmons the first thing I asked was 'is there a script.' He said 'yes' but it will only be released to the 4 main characters (PP MJ HO and the bad guy) 6 weeks before filming. Everyone else gets it 2 weeks before Each Shoot! This is to ensure nothing gets leaked." NEWSFLASH! IGN Filmforce recently visited the set of Batman Begins. While there they talked about the Batmobile with the SFX Supervisor and Production Designer. They also talked about the Batsuit with the Costume Designer, Costume FX Supervisor and Key Costume FX. IGN has posted a great point-by-point informational piece on the ins and outs of the Batsuit and Batmobile from info they learned on the set, with several interesting tidbits on each. NEWSFLASH! RopeofSilicon.com recently caught up with Neil Gaiman at the Sarasota Film Festival, where his film MirrorMask is showing. The film debuted at the Sundance Film Festival, which Gaiman said was exhausting, but said, "...the reviews and the audience reactions were amazing." He later said, "This is a family film, for kids, teenagers and adults, but not everyone is going to enjoy it." He added, "The first ever screening was at a high school, where the majority of the kids thought it was the coolest thing they had ever seen." NEWSFLASH! Constantine Director Francis Lawrence told Sci Fi Wire that he had to edit out an entire character, a half-breed demon named Ellie who is derived from a character in the Hellblazer comic the movie is based on. Lawrence said he made the cut to shorten the running time and better define the main character John Constantine. Lawrence explains the scenes cut and why they were cut in the interview. He finished by saying, "I think we're going to do an extended edition of the movie, and I'll put the scenes back in for that." NEWSFLASH! M&C Soundtracks has a look at the artwork for the Constantine: Original Motion Picture Soundtrack, as well as a track list for the release.
