Free Peer-to-Peer Magazine Portal Launches; MPA Threatens Legal Action

Mygazines.com is registered to a company with post office box in Anguilla. Here we go again. Following in the barely legal footsteps of free, peer-to-peer digital magazine sites that have come before it, Mygazines.com, a Web site that enables users to “share” magazines as they would in “a doctors' office, law firm, library and hair salon,” launched today.

The site already boasts current issues of dozens of magazines, including People, Playboy, Dwell, Domino, Allure, Spin, Smithsonian, Popular Science, Martha Stewart Living, New York, Men’s Journal and Esquire.

“This is a blatant infringement on all magazines’ copyrights that we’re taking very seriously,” Lauren Starke, director of public relations for New York magazine, said in a statement to FOLIO: Wednesday. “We are working with our legal counsel and the MPA to put a stop to this abuse of magazine content.” A Hearst spokesperson said the company was exploring similar legal options. And the MPA weighed in with a statement to FOLIO:: "We believe [this] is a blatant copyright infringement of our members’ titles. We are aggressively pursuing the matter in conjunction with our members’ attorneys and expect that legal action will commence shortly.”

Magazine Industry: Be Green So We Don't Have To

All that stuff I said about the magazine industry not being green? I take it all back, because now they have...a logo!

This little guy is the "centerpiece" of a new campaign by the Magazine Publishers of America reminding consumers to recycle magazines when they're done with them. "The key objectives of the campaign are to overcome the lack of public awareness that magazines can be recycled in the vast majority of communities in the U.S. and, thereby, increase the percentage of used magazines that are recycled," says the trade group. MPA has also ginned up a handful of public service ads that members will be encouraged to print in their titles.

Now, it's all very nice that the magazine business is taking an interest in the environment. And doing a little bit of good is better than doing none at all. But a skeptic might suggest that if the industry actually wanted to shrink its carbon footprint -- as opposed to wanting to be seen as shrinking its carbon footprint -- there's a lot it could do instead of hiring someone to design a logo that, let's face it, consumers are just going to ignore anyway. (Who doesn't know paper is recyclable?) For instance: figuring out a way to push newsstand sell-through way above the 33 percent level where it now stagnates. Or: doing away with all the junk circulation that publishers buy from subscription agents to keep their ad rates artificially high, resulting in millions of unwanted copies being pushed each month on people who will never read them.

Time Inc.'s FSB Shifts to Custom Publishing Unit

In recent years, Time Inc. has shut down publications including Life and Business 2.0 and pared its editorial staff in pursuit of cost-savings. But the company is taking a more unusual tack with Fortune Small Business, shifting the title out of Time Inc.’s Fortune Money Group to its custom publishing unit, Content Solutions.

Time Inc. will save money by letting go 14 of 17 staffers at FSB, including its managing editor, Dan Goodgame, a 23-year vet of Time Inc., and by using existing Content Solutions staff and freelancers to produce the magazine.

As a controlled-circ title that’s distributed free to 1 million small business holders of American Express cards, FSB already operated under a different model from other titles in the Fortune Money Group. But Time Inc. and AmEx Publishing maintained that unlike traditional custom publications, which have advertiser oversight, FSB would remain editorially independent. Goodgame’s No. 2, Brian Dumaine, will oversee the title and report to Fortune managing editor Andy Serwer. Sales responsibility will continue to fall under Fortune publisher Hugh Wiley.

AMI Revenue Dips 2 Percent During First Quarter

American Media Inc.’s estimated fiscal first quarter 2009 operating revenue was $118.8 million, down 2 percent from $121.1 million over the same period in 2008, the company reported today. The celebrity and fitness magazine publisher reported $500,000 in net income, up from a $100,000 net loss during the same period last year.

AMI attributed the dip in revenue to soft advertising revenue and “economic pressures.” Bank EBITDA for the fiscal first quarter was down 9 percent to $33.3 million, from $36.4 million during the same period last year.

AMI also reported that between March 2006 and June 2008, the company eliminated 132 positions (from 877 to 745), a 15.1 percent workforce reduction. Last month, AMI reported its fiscal 2008 revenue was $491 million, up about 4 percent over 2007.
