Women's Wear Daily THE SOURCE'S DAY IN COURT: An attempt by The Source's principal lender to take control of the struggling hip-hop title seemed to falter in court Wednesday when the judge overseeing the case expressed sharp doubts about the plaintiff's legal strategy. Thomas Finn, an attorney for Textron Financial Corp., asked that Source Enterprises be placed into receivership to keep its executives from driving it into the ground; The Source owes Textron $18 million. The Source's lawyer, David Finkler, countered that Textron is merely a lender, not a stakeholder, and thus lacks standing to make such a request ??” a point that seemed to sway New York State Supreme Court Justice Richard B. Lowe. "It's your position that any creditor of any business that is not being run to the creditor's satisfaction has a right to go into court and ask for a receiver to be appointed?" he asked Finn skeptically, before agreeing to take the motion under submission. As Source founder David Mays looked on, Finkler also noted that The Source had received a stay on an eviction order that would have driven the magazine out of its 23rd Street offices this week, and was negotiating a lease on a new space at half the rent. But The Source did lose one legal skirmish when Finkler asked Lowe to seal the record of the proceedings and block all parties from speaking to the press. "The preference of this state is against sealing court records," Lowe said. "You simply want it sealed so the public doesn't know there's litigation here? That application is denied." ??” Jeff Bercovici
