Time settles in probe of subscription renewals

Magazine publisher Time Inc. has reached a settlement with 23 states after a probe into its subscription renewal practices, state officials said on Tuesday.

Under the agreement, Time Inc., owned by media conglomerate Time Warner Inc., will pay $4.5 million to recoup the states' costs for investigation and establish a fund for consumers' restitution.

The Pennsylvania and California attorneys general said Time Inc.'s payout would amount to $4.3 million if all affected consumers respond.

ROLL CAMERAS: American Media's reality show may be burning in development hell, but Jann Wenner's contribution to the candid camera genre is coming along nicely. Casting gets under way this week with an ad in the new issue of Rolling Stone calling for applications. "Respected music magazine seeks dynamic, culture-conscious writers to work at Rolling Stone and be on MTV," reads the copy. Would-be participants will be instructed to submit videos of themselves, along with writing samples or links to their blogs, for a shot at one of six to eight slots on the as-yet-untitled program. Shooting is scheduled to begin in mid-June.

Defying the usual conventions of reality TV, the cast members will be selected based largely on merit as opposed to, say, sex appeal and a penchant for sociopathic behavior, according to Gary Armstrong, Wenner Media's chief marketing officer. "Because this is journalism, writing skills are going to take the lead, as opposed to 'Do you have a lot of tattoos and are you sexy?'" he said. They'll also be judged on their responses to a questionnaire that asks "What three stories would you pitch to your editor?" and "What do you think are the most important qualities for a journalist?" "It's totally earnest," affirmed Armstrong.

Maybe too earnest for its own good. The last MTV reality series based on the magazine world, "Miss Seventeen," also touted its own high-mindedness ??” and drew so few viewers that the network dropped it. But whereas "Miss Seventeen" had an all-girl cast, the Rolling Stone show will be co-ed. That will provide the necessary frisson, said Armstrong, noting the show's casting director also cast "Laguna Beach" ??” which easily outdrew "Miss Seventeen." "There will be [sexual] tension," promised Armstrong.

T BILL: The New York Times Magazine may not have generated much buzz since Gerald Marzorati took it over in 2003, but Marzorati's expansion of it into a group of titles that includes the T luxury and the new Play sports brands has been among the few bright spots of the paper's weakened bottom line. As a vote of confidence, he was promoted to assistant managing editor at the Times on Tuesday. In his new role, Marzorati's duties will include scouting editorial talent internally and working with a team of editors to map out a future for the paper.

"I think a big part of it is simply a recognition that....[the Times] is not something that's simply going to be a broadsheet anymore," he told WWD Tuesday. "That to me makes this a very exciting time to be part of the leadership of this place."

Marzorati will also continue to have editorial oversight of the magazine, at least for the time being. "I need to be working on a tangible product. I don't think I can function as well as an abstract manager," he said.

THE American Society of Magazine Editors is trying to jazz up its annual National Magazine Awards.

It's already known the editors are ditching the big mid-day snoozefest luncheon at the Waldorf Astoria for a swankier night time event in the Jazz at Lincoln Center venue at the new Time Warner Building May 9.

The plan is to line up celebrity presenters and entertainers for the awards, which will be celebrating their 40th anniversary.

"It's not like we're going to turn into the Golden Globes or anything, be we will try to add a little more glamour and star power," said Mark Whitaker, editor of Newsweek and president of ASME.

2005 Best-and-Worst-Selling Covers

So purportedly said the late, great football coach Vince Lombardi during his championship run in the 1960s. It is a quote that has been misinterpreted and misapplied for 40 years, but be that as it may, under Lombardi's standards, Hilary Swank and Reese Witherspoon are winners for their 2004 and 2005 Best Actress Academy Awards . Natalie Portman is a winner for pursuing a Harvard degree, and Pen?©lope Cruz is a winner for her elegant acting in two languages.

Yet, Americans made them all worst-sellers last year (though Witherspoon is also a best for the Part 2-charted Marie Claire). Instead, newsstand buyers preferred covers of women with less esteemed reputations. For example, Jessica Simpson, whose "Daisy Duke" starring role in The Dukes of Hazzard "won" her a "worst actress" Razzie nomination, was Glamour's best-seller. Kid sister Ashlee, of lip-synching fame, was best for CosmoGirl! Britney Spears, whose $$$/millions did not include the purchase of a car seat for her infant son, sold most for Allure. And, for the "boys," Tom Cruise was tops for Details in the midst of his many antics.

Also resonating was a different form of headline-maker, weight loss, as American men and women have a heightened concern about physical appearance for both health and attraction. Thus, Good Housekeeping's 2005 best-seller is revealed (page 1) as it is reported that soft-drink sales in 2005 dropped for the first time in a generation. Cup cakes fared better for Country Living (see below), but worse for Better Homes and Gardens.

Premium information network Congoo, Branchburg, NJ, formally launches today. Congoo lets users search premium or restricted content from trade magazines, newspapers and other publications.

Congoo users download a browser toolbar, the Congoo NetPass, and register once to access limited, premium content. The idea is to provide only a few articles to whet consumers' appetites and fuel more subscriptions for publishers, Congoo president/CEO Ash Hashed said.

Among those providing limited access are TheStreet.com, Editor & Publisher, The Boston Globe and the Chicago Tribune.

Hearst Creates Digital Unit

Hearst Magazines will create a dedicated digital unit, Hearst Digital Media, to oversee development of the company's online properties.

Hearst Digital Media will develop digital applications and technology for its magazine brands, including video content, podcasting and mobile offerings. The unit will also continue to work with iVillage, which was recently acquired by NBC Universal and currently hosts Hearst's women's monthlies Cosmopolitan, Good Housekeeping, Marie Claire and Redbook.

Black also said Hearst signed over 1.3 million subscriptions online last year across all Hearst titles and several multimillion dollar advertising programs for its teen titles CosmoGirl and Seventeen. "Our investment in building a digital presence goes beyond finding new channels to distribute our content," she said.
