HELP NEEDED IN TENNESSEE

I am still having trouble with Unum.  I have filed complaints with the Tennessee Insurnace Fraud Commission.  I am starting to believe they are on their side. I can not find an attorney here who is willing to help me.  Do you have any suggestions? I continue to get sicker and sicker. They royally screwed me over. And I can prove it.  I just need help.

My reply: Thanks. Glad to know we are effective, and they know they can't bury it now ;') After Sept. we will bug them again, just to keep them honest. The NAIC is funded by insurers so my faith in them if they are not prodded and bothered or perhaps exposed, even if they talk real nice, is not quite as high as a caterpillar's rump ;') Or, as the saying go, Unum lawyers are so low they could walk under a caterpillar with a top hat on.

Oh, here is another small roadblock the insurance commissions have put up, from one of my sources: "The ongoing investigation of UnumProvident practices has not yet been finalized.  The target completion date is September 2004.  Once the examination report is finalized, it will be available under Freedom of Information Act statutes in the participating states."

It stinks they are burying it under the obscurity of FOIA instead of making it public.  Uh, aren't insurance commissions publically funded entities that are supposed to protect and inform the public, not hold onto things until they are pried out? (Reminds me of the Federal Energy Regulatory Commission, which tried to keep the tapes of Enron energy traders gloating about their crimes a secret. Your government is not on Your side, folks.  ) Also, isn't there a per-page fee for FOIA requests, which may discourage many financially ruined Unum victims? I recall that's an old trick of the government to hide things. Make them difficult or expensive to get.

You know, things are getting so corrupt that reality is almost like a parody of itself.  Things that would have been a satire ten years ago are now simple truth, and the public is so stunned at the massive barrage of daily corruption that no one is doing anything about it. Corruption is no longer the exception, it's the rule.

Don't worry folks - I'll get the report by hook or by crook, although I sure ain't paying for it, and then Everyone gets it ;') Then we'll sift through it for the boners. It could be they'll have an opinion written by the corrupt MA commissioner that almost exonerates Unum, but the detail data will damn them. That often happens.

COMING UP

Judy's Unum case in a nutshell.

People have been complaining they can't find all the documents, so they are now all together in one link on the top of the front page of www.corporatecrimefighters.com  However, I have the docs password portected until Judy can check the redactions. The link will be unpassworded in a day or so, so go check then.  One of the totally insane aspects of the judicial oppression Judy has suffered is that although everyone else in the world can have the claims manuals and cite them, she cannot since she is under a gag regarding that and will be fined by our pro-insurer judiciary.  So she has to redact any citation of them. It's insane and it's unjust, but that's the law in these here United States.

In other news, I got another complaint from a 9-11 victim. According to our sources, soon after 9-11, Unum made a concerted decision to cheat all the 9-11 victims since they were high-payout claims. You would think the media would be interested in this horror, but I've been unable to interest them. Indeed, one reporter was told about it, looked into it, but backed off when unum complained. So much for the courage of "journalists."

Unum also cheats disabled state police en bloc. No interest on this either. Go figure. Now if I had the dish on Joe Millionaire or that idiot Paris Hilton I'd be able to get attention from what is laughably called "journalists."  Every day my opinion of the American media sinks lower and lower. It's just a progaganda organ for government , political interests and the corporate world that pretends to report the news now and then.  But since they're afraid to print Real news that would wake up the people, it's mostly all about celebrities and other idiocy. The media spent more time on Joe Millionaire than they did investigating the claims that led to the war in Iraq. I knew those claims were false a year ago but these highly paid "professionals" are just now finding out. I also know that  this war , which cost billions of dollars and thousands of lives, has actually strengthened terrorism, since it had absolutely nothing to do with it - but we'll be finding that out in the future.

I'm not making a political point here. I'm making a point about the media. If I knew all this a year ago, and it has all proved to be correct, where in hell was the media, which is supposed to warn us and inform us when our government become reckless? Even if you differ with my interpretation of the facts, or have other facts, what is disturbing is that the facts were neither presented nor debated for something so costly and important to the nation. Instead we got Joe and Paris.

Good Lord, when you go to war shouldn't you at least talk about it? All the tough guy reporters were agog about being "embedded" and getting to take pictures of tanks. But that wasn't the Real story. The real story, the genesis, justification and reason for this war, was ignored.

Frankly, if you only get your news from television, you are going to be woefully ignorant most of your life until the axe falls on your neck.

IS IT WORTH FIGHTING?

After reading a lot of the information on your website, I am wondering if it is worth fighting Unum? Does anyone ever "win" their disability claims with Unum? I was recently denied continuation of my disability payments from Unum after the first 24 months. Apparently the policy calls for a "status review" after 24 months. They find now that I am able to perform the substantial and material functions of my former job as a bookkeeper. I disagree. They give me this information about "providing more information to rebut their decision" or "filing an appeal". I am wondering, is this a waste of time? It certainly sounds like it from reading all the horror stories on your website.

I'm not sure what to do. I certainly need these disability payments but I wonder how much it will actually cost me in legal fees to get them and then is it worth it in the long run. I already have an ulcer from all of this aggravation they have put me through in the first two years.

Can you tell me if it is worth fighting it? Can it be done by yourself? Do I need to retain a lawyer immediately? And, how much is that likely to cost me? Is it worth it or should I just give in to them and let them keep my measly $500 a month?

Webmaster's comments: What do you think? It's a hard call sometimes. The hell Unum puts people through is sometimes not worth the payoff. OTOH, I wouldn't simply let them off the hook. One problem is this is a low rate ERISA case, so it would be hard to even get a lawyer. My advice was to keep plugging at them and not allow them to get away with their theft, but not to expect anything or wrap your life around it.

GOOD NEWS FOR A CHANGE

One of our readers has gotten their claim by using information from our contacts and newsletter. They cited Llinda Nee's information and the class action information in particular.

It's good to know we have Some effect.  At times the response I get on donation or other requests is so slim that I wonder if anyone is listening or it's worth the bother.  Although I have to say that your response on bugging the sluggish and secretive NAIC was Very good. Those of you who didn't bug the NAIC are stil welcome to make a donation to the cause ;')

MASSACHUSETTS SUIT

Subject: MA suit

I was municipal employee for ten years with the town of wellesley.  Unum was paying my claim from 2/200 0thru 4/2001.  Then they denied my claim stating I could retunr to work.  My doctors feel I am totally disabled.  Because i was municipal employee I am not eleiglebe for SSDI.  the judge for SSI has approved my claim as totally disabled but because of my husbands income I do n ot recieve any SSI benefits.  We are in the process of filing Chapter 7 Bankruprtcy.  i have been trying to find a lawyer to handle my case.  The first didn't feel I had a case in 2001.  Since the the next three felt they had to many cases to handle and couldn't do mine also.  Please help thank you.

I wish her luck if she's from MA like Judy. Their dept of insurance is Totally unhelpful. But then, most of them are.  I really don't know What purpose DOIs have, since protecting or serving the public isn't one of them.

YET ANOTHER DOCTOR TURNED LAWYER BY UNUM

Re: Your May 26, 2004 Piece on IME "Whore" MD's

Jim Mooney & Co.,

I've contacted you several times in the past, as an MD, an ophthalmologist, and as an Unum Victim, and now as a Law Student as well. Thus, I couldn't pass up this opportunity to once more add my two cents, especially regarding something so relevant, and perhaps add some clues as to how one could get to such ilk. I would also add, that it is the likes of Unum, its Big Business Partners-in-Crime, and the Bought-and-Paid-For Black Robes, et al, that have inspired my present involvement in our so-called "Legal System."

First let me say that not only am I not offended as an MD, by your reference to a certain subhuman species as "Whores," I believe most honorable MD's would applaude your sentiments as well, as they also makes us "good guys" look bad. I would also add, that there are many MD's who charge up 5-10 times the standard rates as "Expert Witnesses" for the patient victims' side as well, once it becomes a "legal" issue, who therefore, are equally as predatory.

As something of an "Educated Consumer Layman Advocate," who has logged many a "pro se Trials," I have some very specific thoughts on this matter, ideas that seem are often over looked by both attorneys and advising physicians, as they are ignorant of each others fields, and assume the other knows more than they do. Eg., any physician who draws conclusions without actually examining the patient, or flippantly discards another physician's long relationship with said patient without diffinitive irrefutable evidence, is not only legally "not credible," but may well be guilty of malpractice, and even subject to discipline by various state and other "Boards of Medical Misconduct," many of which would love to go after such bad apples. Ditto for any other professional fields with similar boards +/or licensing. If precedents are set, and these dishonorable sorts are held accountable for their actions, they may be much more reluctant to so violate their "codes." This is important to note, because courts and lawyers will almost never, of their own volition, follow-up on the misdeeds of professional witnesses (not to mention Lawyers). I know specifically of what is known as the "Goldwater Rule" by the by the American Psychiatric Society (a result of the press "Dissing" suffered by Barry Goldwater from write-in diagnoses to newspapers, by many psychiatrists during his Presidential run against LBJ), that any Psychiatrist who diagnoses a patient he/she has never actually seen, is subject to immediate expulsion from that society, and therefore probably a prime target for a lawsuit themself, and possible professional disciplinary action. Furthermore, any non-physicians (as in insurance case examiners, etc.), who draw makes statements in reports, testimony, memos, etc., that stray from exact medical quotes, conclusions or diagnoses, should be taken to task for "Practicing Medicine, Psychology, etc., without a license."

I consented to my IME by Unum's shrinks (4 1/2 years after-the-fact), only under the condition that they were all tape recorded! Videotaping is even better. This goes toward their accountability, which worked especially well for me as an MD, since they knew they couldn't pull their usual BS. I also challenged their own expertise, since they were both "forensic shrinks," who besides criminal tendancies, are qualified primarily to determine whether or not someone was malingering, as I so prefaced at our meetings. This was to put them on notice that they had better cross every medical "t," and dot every professional "i." Also, they love to draw biased conclusions from standardized tests, which I noted (on the record) were designed to be given only by someone who was trusted by the subject as doing it in their best interest. Therefore, any conclusions arrived at by such prostitutes, are ipso facto "Invalid."

I also know from heading my own PC for 17 years, that my personal "corporate immunity" presumes that I have acted "In Good Faith," and have followed "Corporate Policy." By the way, any Judge's immunity from civil liability is similarly based on their acting "In Good Faith" (although they have, without exception to date, been protected by courts up through the US Supreme Court). The way I see it, therefore, is that any of the "Little People" in an organization can be "Third Degreed" about whether they were following "Corporate Policy," or acting on their own volition, just to get that one victim (the latter, of course making no sense). This is the standard "Trickle-up" tactic (it is known by another term which escapes me at the moment) by which prosecutors get to the Fat Cat perpe"traitors," but I have rarely noticed it employed by attorneys of we "have-nots" in civil matters. Additionally, Judges (and lawyers) are required by law and statute (not to mention "duty") e.g., NY State 100.3, especially sections "D" and "E", are required to report +/or act upon any "malfeasance" commited by another Judge or Attorney.

One more point. As a physician, I have noticed how (understandably) uninformed most attorneys are of medicine (not to mention most other fields), and thus are typically poor at gathering important information from their clients and "The Experts," and in examining and cross examining witnesses. They are also terrible at coaching experts to put things in simple terms or phrases that a so-called "Jury of our Peers" or even a Judge could understand. Cases in point:

1. The "If the glove don't fit, you must Aquit! OJ Jury" who, unable to even spell "DNA," were totally confused with all that them thar "Double Helix" stuff. I guess it never occurred to any of those Southern California types that, OJ's acting aside, leather gloves SHRINK when they get wet (as with blood). Not that they were exactly "open-minded," anyway.

2. "Dis"cision 2000: Where some statistics geek, talking about the inaccuracy of the "Hanging Chad" balloting machines, was about as intelligible as is Fed Chairman Alan Greenspan at his regular Senate meetings. And (speaking of nonsequiturs), Gore's lawyer, top attorney that he was professed to be, obviously hadn't a clue! And, as far as I heard, no one ever mentioned to our infamous "5 to 4 Supreme Court," that if hand counting ballots for those districts (despite their bogus unequal machines, ballots, access to voting centers, etc.) violated "Due Process," then so too did all those hand-counted absentee and overseas ballots!

It is of note, that whereas in medicine about half our training goes to properly taking a History (i.e., "Communicating"), no such parallel effort is made in Legal Eductaion. Therefore, the onus is generally upon the law client to voluntarily on their own, gather as much information as possible, consolidate it into overview terms that even an attorney will get, and think up simplified phrases, and presentations to help "educate" a layperson jury, and from the layperson's perspective.

So there you have my "Two Cents," and then some. Feel free to put it online, and edit as you see fit.

There's a lot more news, but I'll keep this small and do it later since Judy has a newsletter lined up for a day or so from now. On the lighter side, in addition to being an ER doctor and self-trained lawyer, Judy is an excellent artist and seamstress, so she made me a Robin Hood hat complete with feather. (I guess because I help the weak against the powerful.  She insisted I take a picture of me in it. I got a free webcam as part of some necessary software I had to get, so I made a short movie clip so that I could show all sides of the hat, especially the fine feather ;') I was working in the yard in FL right before I came in and decided to take the clip, so I'm shirtless. This is not an attempt at beefcake - I am way over the hill for that ;')  This a rather large .avi movie file so it is a long download on a modem (about 17 megs).  It can be viewed with the latest Windows Media Player or some other .avi player.  Please, no comments on my looks - just admire the hat ;')
