CORPORATE CRIMEFIGHTERS OF AMERICA -- feb 6, 2005 ====================================================== A NOTE FROM DOCTOR JUDY NEWS FROM JUDYDOC ??“ January 25, 2005 I??™m still alive. I??™ve gotten sicker overall and then in October 2003, one of my lumbar discs acutely collapsed spurting the contents of the intervertebral disc (a gelatinous material) backwards into the spinal canal where it compressed the nerves leading to my right leg. The pain was 11 on a scale of 0 to 10, so I had to call an ambulance. I was hospitalized for 3 weeks, on a morphine drip for most of that time. I had back surgery to remove the disc material from the spinal canal and relieve the pressure on the nerves. But the surgery was only partially successful because the bone graft didn??™t heal properly. Apparently my body rejected the graft. So now I??™m a chronic pain patient as well as having MS and CFS. I couldn??™t work on my lawsuits at all. But just when I was about to have to give up because UNUM and the other defendants were filing motions to have my appeals dismissed because, since I was unable to do the legal work, I couldn??™t go forward. I went on one of my frantic attempts to find an attorney, and miraculously, the 6th one was the charm. It was so close to the wire that, on the day of the hearing on the defendant??™s motions to dismiss my appeals I still didn??™t know if I had a lawyer or not. BUT HE DID SHOW UP, and he got the extension he wanted. All of my legal actions have been dismissed at the lower court level, both federal and state. Based on what these judge??™s wrote in their dismissals, however, not a single one was proper or in compliance with the law, the facts, res judica or criteria for granting Summary Judgments. It took him four months to respond to my Motion for Reconsideration. His response consisted of a 1 ?? page opinion essentially stating that to the extent that I was repeating evidence and argument from prior pleadings, he would not consider them, and to the extent that I was submitting new material (like an affidavit from UNUM whistleblower Linda Nee about my claims), he had no obligation to consider it. At least now I have an attorney. I like him so far. I did have to raid my savings to pay him some hefty retainer fees though. On the bright side, my doctor??™s medical assistant hooked me up with some public service agencies and between that agency, the MS society and Medicaid, most of my biggest financial problems are being taken care of. ***************************************************** I want to let you know about an insurance newsletter that is worth the subscription price. It??™s called THE INSURANCE FORUM and is put out by an insurance broker, Joseph Belth, who is truly honest and outraged at what UNUMProvident and other insurer??™s are doing. Joe wrote a letter analyzing the UNUMProvident ???Settlement??? that resulted from the rigged 47 state ???investigation??? and sent it to all 47 insurance departments. In his newsletter, he reprints and/or analyzes and explains many pertinent issues both specific to UNUMProvident and about insurance in general. If you are an attorney with a UNUMProvident victim/client, you should get this newsletter. I don??™t know if Joe is doing any expert witness testimony but I think he??™d be a good person to do that. Judy has gotten some rotten pro-insurer judges but it's also true that most judges don't like Pro Se litigants who act as their own attorney, even if they know what they are doing. Which sucks, since many claimants simply can't find a lawyer (or a good one), especially for "smaller" cases. But what is small to a law firm may be survival to a victim. The only other news is that the number of people who have actually subscribed to help us out has risen from about one percent to nearly two. So for those of you who are keeping our heads above water, if just barely, thank you.
