It will be a shame if I cannot continue to whack them. /////////////////////////////////////////////////////////////////////////// CREEPING FASCISM House approves electronic ID cards --The U.S. House of Representatives approved on Thursday a sweeping set of rules aimed at forcing states to issue all adults federally approved electronic ID cards, including driver's licenses. Under the rules, federal employees would reject licenses or identity cards that don't comply, which could curb Americans' access to airplanes, trains, national parks, federal courthouses and other areas controlled by the federal government. The bill was approved by a 261-161 vote. Webmaster's comments: Hey, why don't we just throw away the whole damn Constitution, that millions died to protect, so the Fascist Nanny State can protect us from bad old Osama? Cripes, we are a target in the world because we meddle so much in the world. If we stopped our meddling in the internal affairs of other nations, it would protect us a lot more than totally destroying our own rights and our own privacy. That doesn't excuse bad people from other nations who commit monstrous crimes and deserve to be whacked. But I KNOW from reading true history (not the bilge you get in the newspapers and on TV) just how many international problems have had their roots in our government meddling with other nations on behalf of our corporations and their profits. What's next - a number tatooed on our forehead and govt. spycams in every room? This sucks. ////////////////////////////////////////////////////////////////////////// A NOTE FROM JUDYDOC Hi Everyone: Item 1: We are not the only ones being screwed. I like to read the comic section of the newspapers and many of the issues that affect us are affecting SO MUCH OF THE POPULATION that the funny pages have story lines about them (HMO denials, dumb doctors, etc.) Boston Globe, Friday, Jan. 28, 2005 strip "Non sequitur" by Wiley Two guys sitting at a bar. Man 1: "What ever happened with all of those cases of corporate corruption?" Man 2: "Oh, they were settled out of court." Man 1: " Really? So what was the settlement?" Man 2: (looks like he's trying to think of something) Man 1: "Oh, Yeah. Campaign Contributions." Man 2: "Duh" So UNUMProvident's $15 Million will be used to fund campaign messages for State Insurance Commissions, just like our old friend Quackenbush from California did 5 years ago with the "penalties" assessed against the Home and Casualty Insurers who screwed people on Earthquake claims. Quackenbush got "outed" by an honest attorney at the Department (a whistleblower) who made copies of all the Market Conduct Reviews, each one marked with "Action to be determined at a later date" where they were supposed to make the companies correct their crooked ways. Then an honest state representative (Escutia) published the documents on her website. Of course there was pandamonium and threats to the whistleblower and Escutia for stealing and posting these allegedly "confidential" documents. Ultimately though, Quakenbush resigned (there must have been an honest lawyer in the prosecutor's office threatening to prosecute him) and the whistleblower was ultimately allowed to keep her job - actually when she returned to her office after having to undergo an interrogation by the state officials, the office staff gave her a standing ovation while she was being escorted to her office to empty her desk. But it was nervewracking for her for a few months when she didn't know if they would actually prosecute her! Boston Globe, ? date in January, 2005 strip "Sylvia" by Nicole Hollander First Panel: A fairy godmother waves her magic wand and the caption says "A vengeful Royal puts a curse on a young girl in her pram." Second Panel: A woman with a wand is saying to a baby in a crib: "Priscilla, because your mother always pushed ahead of me in the cafeteria line at the palace, you will grow up to a a judge who favors corporations over consumers, employers over workers and insurers over sick people." The baby replies: "which will put me at the front of the line to be nominated for a federal judgeship. Nyah. Nyah, Nyah. This explains the odd and corrupt behavior of ALL OF THE JUDGES I've been up against, especially Judge Ponsor. ******************************************* Item Two from Judydoc: "Tort Reform" may be a good thing. My father pointed out to me that if Tort Reform goes through, there will be a sudden and drastic drop in the need for highly paid insurance defense lawyers and law firms. Since the insurers won't have to fight to the death to prevent precident setting large punitive damages awards, they won't be willing to pay the insurance defense lawyers more than the contractual value of the claims. ERGO, if you fight them back, when it starts to get expensive, the insurer will PAY THE CLAIM and end the need for the insurance defense lawyers. Plaintiff's lawyers can still get paid their usual fees or a percentage of your claims. Judges will be more likely to award attorneys fees above and beyond the contractual fees (so the claimant and their attorneys will be reasonably satisfied). So think about tort reform as a way to eliminate the jobs of lawyers like Pat Peard and Katherine Robertson. Right now, my case is probably costing UNUM over a million (these lawyers probably charge about $450 to $550 per hour and pad their hours). Since the "end result" will pretty much be limited to contractual damages and plaintiff's attorneys fees and costs, the cases will get to trial or judgment faster. I think there are plenty of lawyers that are willing to take cases where they will get their $350 to $450 per hour fees paid and judges wil be more willing to award them because they will know that these are NOT attorneys attempting to make HUGE amounts off the punitive damages. We may actually see MORE people able to sue (assuming insurers don't simply start paying these claims), because it's much easier to make simply contractual damage cases then it is trying to make the case for the huge punitive damages (where you actually have to have insiders and smoking guns, and evidence of mass conspiracy - even though we have this, it's time consuming and expensive trying to get it legally admissible through discovery. So LET THE BUSINESS COMMUNITY LIMIT DAMAGES FOR PAIN AND SUFFERING. UNUMProvident is paying MILLIONS a year (I have the numbers here from the Schedule J that they have to file with the DOI's. A LARGE percentage of these lawyers and law firms will BE OUT OF WORK if tort reform goes through. In fact they will probably go back to suing FOR POLICYHOLDERS. Here's the summary of Schedule J for UNUM PRE-MERGER "Showing in detail all expenses paid during the year (List individually all items of $5000 or more) So they have to list the law firm and the amount and then there a total for each year. Totals as follows: Year 1990 - $764,013 Year 1991 - $2,658,202 Year 1992 - $4,712,539 Year 1993 - $3,550,627 Year 1994 - $4,805,037 Year 1995 - $7,018,473 Year 1996 - $10,089,427 Year 1997 - $11,294,884 During this same period, UNUM had to report on Schedule F, individually and then totalled, all group disability claims denied or resisted for the corresponding year. They list amount claimed and amount paid. In the amount paid column there are pages and pages of ZEROS (hundreds), and increasing totals for the years, from 1991 when the total of these denied GROUP claims (doesn't include Individual policies) was $3,932,036 to 1997 where the total of this category was $35,890,210. Oh, won't it be nice when we see a lot of these pompous greedy corporate defense lawyers getting pink slipped because, thanks to tort reform there are fewer lawsuits and fewer causes of action in each lawsuit so they won't drag on forever. Webmaster's note: I'm not sure I totally agree on this one. (Yes, I actually have the nerve to disagree with Judydoc ;') My feeling is the $#@! insurance companies will fight every claim to the death Anyway. After all, their reluctance to pay is what started this whole litigation cycle. It's just in their blood. I remember when no-fault swept the nation it was supposed to make auto insurance go down. Guess what? It didn't. The insurers just pocketed the difference. They have always cherised the notion of maximum premiums coupled with zero payouts. Have you ever noticed how the bad guys pick such great sounding names, though? It's always "Citizens for **** Reform" or something like that, when they really mean "Simple Dupes for Corporate Crookery." I guess I'll have to improve my semantics since their choice of words makes people who object to their deceptions sound anti "reform." ;') ********************************************* Item 3 from Judydoc: There's a radio show that I listen to called "Democracy Now." It's the "alternative news," i.e. the REAL NEWS. Their website is "DemocracyNow.org" You can find a station in you area for the one hour news program hosted by Amy Goodman, as well as links to other "subversive" stuff - i.e. the news, videos, writings, people, that mainstream propaganda news fails to report. CHECK IT OUT! ********************************************* Item 4 from Judydoc: Since Jim's mother died, Jim has NO INCOME since he was taking care of two dying parents who needed full time care and is just shifting gears while paying final expenses (of course there was no life insurance). He's also doing a lot of work fixing his house so he can sell it and move to Massachusetts to help me. And he's trying to pay for repair materials. He can't just go out and get a job that pays anything that quickly at his age and health. He would have to quit in a few months after costing them in training. Jim doesn't even like to screw employers as much as he rails against corporations. It's a matter of honesty. Will someone out there either SEND JIM a couple thousand dollars or make a SHORT TERM LOAN that he will pay back just as soon as the house is sold? That will free him to fix it up and get out of there so we can work together on Unum. There is a reason he needs to be here soon (below) but that won't work if he has find a long term job there and struggle along for another year. Things have to happen now. I told Jim he could save money by shutting down the website and not having to pay all the costs associated with it, but he really doesn't want to do that, although he may have to turn off his phone next month to pay other bills. If you folks don't show some appreciation for what Jim has done, HE WILL SHUT DOWN. Especially you lawyers. One firm told Jim they couldn't donate because it might raise conflict of interest questions. First of all THIS IS BS...Second of all, JIM WILL BE HAPPY TO ACCEPT ANONYMOUS DONATIONS. There are also folks out there who have won big awards from Unum who could help. You would think they would be glad offer some truly substantive help to someone who is still campaigning for victims and exposing the company that made their life hell. But I guess people change from "Humanity should be interested in my plight" to "Humanity who?" when the check comes. There are even multimillion dollar law firms who have gotten free publicity and research from Jim, but who have been oddly absent when it comes to helping out. Although not all of them. Oddly enough, the smaller firms seem to be more helpful than the larger ones, except for Eugene Andersen, who has been a great help to Unum victims and their advocates in a number of ways. Once Jim sells his house and moves up here, we have a paying job waiting for him, so he will be once again supporting himeself. BUT HE NEEDS SHORT TERM CASH NOW!! ********************************************* That's all Judydoc has to say except that I found a well done medical article in my Family Practice magazine that has convinced me that a second back surgery will really help me. Since I trust the guy that did the original surgery, I'm looking forward to telling him to schedule me just as soon as my friend Jim gets up here to help me in the post-op period. That's another reason I'm trying to get him immediate help, so there are no delays or tieups. My back pain is worsened by exercise, so I'm gaining weight, which make the problem worse, etc. What I have is called "spinal stenosis." My lower lumbar vertebrae kind of got mushed together, probably from years of horseback riding. So if he can carefully clear away the bone spurs and scar tissue and regraft the two vertebrae that are unstable, I think he may actually be able to REALLY REDUCE or even eliminate my pain. Right now I'm on round the clock opiates, although I finally got permission from my doctor and Medicaid us the skin patches. The Patches (Fentanyl) really are GREAT. Two to three patches every three days replaces the 8 long acting morphine per day and 4 Tylox (short acting synthetic opiate) that I had been taking since my back surgery. So 2-3 patches eliminated 36 pills! Plus eliminating all those times I dropped those tiny morphine pills on the floor and had to bend over to pick them up (or go and get some kind of picker upper which don't do a really good job of picking up tiny pills off the floor.
