Gandhinagar, June 4 (IANS) :

The opposition in Gujarat has slammed the government for
giving a plum post-retirement post to the judge who
delivered a controversial judgement in the Best Bakery case.

Former additional sessions judge H.U. Mahida, who was
last month appointed legal advisor by the state-run
Gujarat Electricity Board (GEB), had been censured by
Supreme Court, after he acquitted all 21 accused in the
case.

The case arose after a mob burnt to death 14 people,
including 12 of the minority community, inside a building
housing the Best Bakery, on the outskirts of Vadodra,
100 km from here, on March 1, 2002 during statewide
communal violence.

"While Mahida's controversial judgement stands criticised
by the Supreme Court, the state government has honoured
him with a post-retirement position," leader of the
opposition in the state assembly Amarsinh Chaudhari told
reporters Friday.

"Moreover, Mahida will be paid Rs. 30,000 a month as
honorarium compared to Rs. 15,000 paid to his predecessor.
It shows where the state government stands when it comes
to ensuring justice to riot victims," Chaudhari added.

Mahida's fast track court at Vadodara had acquitted all
the 21 accused after a majority of witnesses turned hostile.

Zahira Shaikh, a prime witness, later alleged before the
media that she was forced to withdraw her statement under
threat. She said that she did not feel safe in the state
as the police administration was biased against the
minority community.

Following her petition, the Supreme Court directed the
transfer of the case to the where retrial proceedings
begin Monday.

Congress demanded that the opposition be consulted in
the appointment of the public prosecutor for the retrial.

"We admit that there is no such precedent, but given the
government's track record in the matter, we feel that we
should be consulted in appointing the public prosecutor
in the case," Chaudhari said.
