SC refuses to hear Dhananjay’s petition Our Legal Correspondent NEW DELHI, June 25. — The Supreme Court (coram, Balakrishna, Reddi, JJ) today refused to go into the petition filed by Dhananjay Chatterjee, sentenced to death for the rape and murder of a 15-year-old girl in 1990, challenging the West Bengal Governor’s decision to reject his clemency petition. “The matter is being examined by the President under Article 72 (of the Constitution). So we are not inclined to entertain this petition at this stage,” the Court observed while disposing of the petition filed by Dhananjay’s brother Vikas and others. The court, before passing the order, took note of the Government of India’s communication to the Bengal government yesterday, directing it to stay the execution scheduled for Friday on the ground that his clemency petition had been referred to the home ministry by the President and was under examination. Dhananjay’s lawyer, Mr Colin Gonsalves, however, stated, his client retained the option of exploring legal options if required later. Earlier, appearing for the West Bengal government, senior counsel Mr Tara Chandra Sharma vehemently opposed the petition. “The convict’s mercy petition has been rejected by the Governor thrice and twice by the President. The third plea for clemency is pending with the President now,” he stated. Even the Supreme Court, while remanding the matter to the Governor for consideration, had opined that the delay in executing the death sentence cannot help the convict, he pointed out. Mr Sharma dismissed the convict’s petition as “frivolous” and charged that they were intended to “misconstrue” the law. Dhananjay was convicted and sentenced to death in January 1994. The trial court order has since been confirmed both by the Calcutta High Court and the Supreme Court. |
