#1 Rediff News, June 29, 2004, Tuesday Ahmedabad encounter to be challenged in SC Sheela Bhatt in Ahmedabad Prominent social activist and lawyer, Girish Patel, will file a PIL in the Supreme Court seeking an inquiry by the Central Bureau of Investigation into the June 15 police encounter in Ahmedabad, in which four alleged Lashkar-e-Tayiba terrorists were killed. Patel told rediff.com that the PIL will be filed in a day or two and that it will be supported by three non-government organisations, including the Lok Adhikar Manch. Ishrat Raza Jahan, a college girl from Mumbai, was one of four killed in the encounter. The petitioners will focus on two questions: a) were the four persons killed in the encounter dangerous terrorists out to kill Chief Minister Narendra Modi as claimed by the Gujarat police? b) was the encounter genuine? "The society should not tolerate such encounters because today some terrorists have been killed, tomorrow it could be civilians' turn if they are perceived as criminals or a threat to the police. The existence of such infrastructure is dangerous," said Achyut Yagnik, a social thinker and writer. Patel is being assisted in preparing the case by Mukul Sinha, a human rights activist. Hashim Kureshi, a lawyer who is holding the brief for more than 55 POTA accused in Gujarat, and who will support the PIL, told rediff.com: "Gujarat police is excellent in writing filmy scripts. And like filmy writers, they make mistakes too. We are probing into the identities of the Pakistani terrorists who have been allegedly killed in the encounter." Kureshi said he is collecting details of Amjad Ali Rana, who was killed in the encounter. Kureshi pointed out that like several other encounters, the June 15 encounter did not follow the rule book. "The accused were not shot in lower parts of their bodies," he said. He also said the police claim of having recovered a diary from the terrorists detailing their plans sounds suspicious. "No sane person would keep a diary of his/her movement and the intentions to kill prominent persons. Before her murder, Ishrat must have been forced to write the diary in the presence of Gujarat police," Kureshi said. He said like four previous encounters in the city, all the alleged terrorists in the June 15 encounter were wearing cheap bathroom slippers. "These are some similarities that will be brought before the court." Pointing out another "obvious flaw in the police theory", Kureshi asked why would Javed (one of the four killed in the encounter) use a car registered in his brother-in-law's name if he was on a mission to kill Chief Minister Narendra Modi as claimed by cops. "It takes just two hours to arrange for a stolen car. Why would he use his relative's car," Kureshi asked. The lawyer said the Gujarat police's another "ridiculous" claim is that they were following the terrorists in their official vehicle long before the terrorists reached near Ahmedabad, where they were shot down. "It's impossible to believe that the 'terrorists' could not see and recognise a police car following them," Kureshi said. ------------------------------------------------------ #2 CHRO News, June 29, 2004, Tuesday CHRO Case On Killi : High Court Seeks Govt Documents A division bench of Kerala High Court, comprising Justice K. A. Abdul Gafoor and Justice P. R. Raman, directed the Government yesterday to produce all documents relating to the alleged police excesses at Killi in Thiruvananthapuram district on October 5, 2003, including the report submitted by the State Human Rights Commission, the Kerala State Women??™s Commission, and DySP Vijayan Unni by July 12. The directives were passed while the writ petitions filed by Confederation of Human Rights Organizations (CHRO) and three others relating to the incident came up before the court. While some of the writ petitions sought a CBI probe, the others challenged the Government order reinstating the police officers suspended in connection with the incident. If the Government failes to present the documents before July 12, the Court would be constrained to reach adverse inferences, the Division Bench said while passing the order. The police atrocities at Killi allegedly took place in retaliation against a confrontation between the police and some local people on the evening of September 28 in connection with the beating up of Ajeer (24) who was riding a two wheeler without a helmet. The Government had earlier submitted that the Additional Director General of Police (Crimes) was investigating the cases registered against the police officers while the Additional DGP (Operations) was conducting the disciplinary proceedings against the officers. They had now been posted to non-sensitive areas. Besides, the interim compensation had been awarded to the victims as ordered by the State Human Rights Commission. The Government would also recover the compensation from the officers responsible for the atrocities as directed by the Commission, the Government had earlier submitted. The State Government had suspended the then Thiruvananthapuram Rural SP, Ashok Yadav, the Nedumangad Dy. SP, S. Jogesh, the Kattakada CI, Jayaraj, the Aryanad CI, Radhakrishna Pillai, the Malayankeezhu SI, Muhammed Hussain, the Nedumangad SI, Pramod Kumar, the Vithura SI, Radhakrishnan Nair and the Neyyar dam SI, Muraleedharan, on December 10 last on the basis of the State Human Rights Commission's report that inquired into the incident. All of them, however, were reinstated within a gap of two months and despite the High Court rejecting a petition filed by the Police Officers Association pleading to stay the suspension orders. According to the petitions seeking a CBI probe, in the conciliatory talks that followed the attack on the police, those involved had volunteered to surrender and the police had agreed to settle the matter in a peaceful manner with the cooperation of the local people. But despite this, the police had allegedly violated human rights, tortured innocent children and women who were sleeping in their houses and committed grave offences and atrocities. The police action disclosed a criminal conspiracy and constituted the offence of dacoity (Section 391, IPC), the petitions said. ---------------------------------------------------------------- #3 New Indian Express, June 27, 2004, Sunday Kerala : CPM Assures Collector To End 11-Year-Old Blockade Against A Widow Express News Service Kuttiadi, June 26: The ???blockade??™ declared by the State Karshaka Thozhilali Union(KSKTU) against a widow at Pathirappatta near here took a new turn today with the Kochi-based human rights organization ???Janapaksham??™ taking the initiative to solve the crisis with the support of the district administration. Accompanied by District Collector T. O. Sooraj, revenue officials and a strong police force, around 40 activists of the organization from various parts of the State reached Vineetha??™s home early this morning to begin work at the 5-acre plot owned by her, where the local labourers including coconut tree climbers had refused to attend work after the KSKTU declared the blockade in 1993. The activists had even brought four coconut tree climbers to do work at the plot. However, they were withdrawn after the CPM leadership intervened and assured the organization as well as the district administration that the total labourers, who were doing the job earlier, would do the job before June 30. According to Vatakara tahsildar V. C. Hareendranath, CPM district secretariat member P. Mohanan has given such an assurance on behalf of the party leadership. District Collector T. O. Sooraj told this newspaper that if the CPM failed to keep its word, the authorities would be forced to employ workers from outside with police protection. ???We decided not to go ahead with our plan because the CPM leaders have said they will settle the issue before June 30,??? he said. Vineetha told The New Indian Express that she is ready to wait for four more days as her family members have been waiting for more than a decade. ???But I do not believe in the CPM leadership since they have not kept their word on many occasions in the past,??? she said. The ???Janapaksham??™ State convener Benny Joseph said the organization has intervened in the issue on humanitarian consideration. Vineetha??™s family have been put to suffer for the past many years and the CPM leaders had not been keeping their promises. ???The ???Janapaksham??™ would file cases against the District Collector and the Superintendent of Police for human rights violation if they failed to employ the labourers at the plot by June 30,??? said Benny. Meanwhile, the KSKTU has convened its general body meeting at Pathirappatta on Monday to discuss the issue in detail. The KSKTU leaders, including its State secretary and CPM State secretariat member A. Kanaran, are known to have objected to the assurance given by the CPM district leadership that labourers would attend work by June 30. RDO P. Balan and Vatakara DySP V. V.
