Indo-Asian News Service, July 06, 2004, Tuesday Mumbai court orders 13 accused in Bakery case to surrender A court in Mumbai conducting the re-trial of the Best Bakery case, one of the worst massacres of the 2002 sectarian violence in Gujarat, on Tuesday ordered 13 accused to surrender within 30 days. Additional Sessions Judge Abhay Thipsay issued a proclamation order against the 13 accused, who are absconding, and asked Gujarat Police to publicise the order in the state's newspapers. Police in Vadodara, where 14 people were burnt alive in the Best Bakery in March 2002, have arrested eight of the 21 accused. Thipsay had on Monday postponed the hearing of the re-trial after the Maharashtra and Gujarat governments failed to iron out procedural tangles over appointing a public prosecutor for the case. The proclamation order identified the 13 absconding accused as Raju Baria, Mahendra Jadhav alias Nanu, Haresh Gosai, Pankaj Gosai, Jayanti Gohil, Ramesh Gohil alias Rinku, Mahesh Gohil, Harshad Solanki, Sanjay Thakker alias Bhapo, Jagdish Rajput, Shana Baria, Shailesh Tadvi and Kamlesh Tadvi. The Supreme Court transferred the case out of Gujarat in April on a plea against the acquittal of the 21 accused by a fast track court in Vadodara, which the high court had confirmed. Since the court in Mumbai began its hearings June 10, they have been postponed thrice due to procedural tangles between the Maharashtra and Gujarat governments. Mihir Desai, counsel for prime witness Zaheera Shaikh, has informed the court that she had moved an application before the Supreme Court to clarify the matter about appointment of a public prosecutor. Special public prosecutor PR Vakil, appointed by the Maharashtra government, informed the court "despite a meeting between the two governments, the issue of who would appoint the prosecutor remained unsolved". The Gujarat government had informed the special court June 21 that Atul Mehta and TS Nanavati had been appointed as public prosecutors, and the state was considering appointing Manjula Rao as special public prosecutor. On the other hand, the Maharashtra government announced a different team comprising PR Vakil, Manjula Rao, Zaheeruddin Shaikh and SM Vora. Confederation of Human Rights Organizations (CHRO) |
