ITEM 1: Put Shahabuddin behind bars: Patna HC

The Patna high court on Monday issued a show cause notice to the District Magistrate and Superintendent of Police of Siwan district for letting Rashtriya Janata Dal Member of Parliament Mohammad Shahabuddin be in hospital while in custody, and ordered him to be put behind bars within two days.

Justice Bal Krishna Jha, who had on July 15 cancelled the provisional bail granted by a Siwan fast track court to Shahabuddin to attend the ongoing monsoon session of Parliament, took the district officials to task for returning Shahabuddin to Siwan Sadar hospital on his return from New Delhi.

The judge ordered the authorities to file a compliance report to the court on July 26.

Shahabuddin's counsel Y V Giri argued that since a copy of the court's order was not made available to the district administration they interpreted the order in that way.

Earlier on July 15, Justice Jha, who had earlier rejected the bail petition of Shahabuddin in connection with kidnapping and murder of a CPI-ML (Liberation) worker Munna Chaudhary in 2001 in Siwan, annuled the fast track court's order and ordered to send the MP behind bars.

The HC, however, granted him bail in three other cases.

ITEM 2: Jamtara police receive arrest warrant against Soren

The arrest warrant against Coal Minister Sibu Soren issued by the Jamtara district court last Saturday, was received by the Jamtara Superintendent of Police SN Jha on Monday.

Earlier, Jha had told PTI that despatch of the arrest warrant was being delayed due to a fire incident at the Deogarh district court on Sunday as many judges were busy with that.

Meanwhile, JMM party sources said a team of lawyers has come from Delhi to challenge the warrant against Soren in Jharkhand High Court.

The fire broke out on Sunday in the Malkhana of the Deogarh district court where files are stacked and the Jharkhand High Court has asked the Registrar (Vigilance) to probe the incident.

ITEM 3: CBI files report on Pappu Yadav's sneak visit to Madhepura

The CBI on Monday filed a report in the Supreme Court on the sneak visit of former MP Pappu Yadav to Madhepura constituency in Bihar even when he was under judicial custody in Ajit Sarkar murder case.

As the report was in sealed cover the Court posted the matter for further hearing on Tuesday.

The court also asked CBI to verify a recent newspaper report alleging that Yadav admitted himself to AIIMS for two years and used to go out of the hospital frequently to circumvent a Court order denying him permission to attend Parliament.

ITEM 4: Gandhi Azad to lead BSP in case of Mayawati's arrest

Fearing a possible arrest in the Taj Corridor case, BSP leader Mayawati has indicated to her partymen that Rajya Sabha member Gandhi Azad would lead the party in the event of her imprisonment.

Highly placed party sources said she gave the indication at the meeting of the party's state and district presidents and office bearers on Sunday.

In her marathon four and a half hour address, she spoke of her possible arrest and said Azad would carry her message to the people.

The sources said that former Uttar Pradesh Advocate General SC Mishra, who was recently made organisation's General Secretary, would look after the legal aspects of her cases.

Mishra has represented her in the controversial Taj corridor case in which the BSP supremo is fearing an arrest.

Party spokesman Sudhir Goyal, however, sought to clarify the developments saying Azad would only be acting as a bridge and coordinator between Mayawati and party workers in the event of her arrest.

"Mayawati has not named Azad her successor but said that he would be continuing her work even if she is in prison," he added.

Give Bhopal gas victims their Rs 1503 cr: SC

Twenty years after the deadly Bhopal gas leak claimed 15,000 lives and injured 500,000 more, the Supreme Court on Monday directed that the money deposited by the Union Carbide as compensation with the court be distributed among the victims.

A bench comprising Justice Shivaraj V Patil and Justice B N Srikrishna passed the order on a

petition filed by representatives of 36 affected wards in Bhopal, which had turned into a graveyard after the leakage of deadly methyl iso-cyante from the Carbide factory on the night of December 2-3, 1984.

The immediate toll was over 4,000, but the figure swelled as people, suffering from the poisonous effects of the gas, continued to die in various hospitals.

The Carbide, on the basis of a settlement reached with the Union government, had deposited $ 470 mn with the Supreme Court in 1989. The court had directed that the money be put in a dollar account. This money was deposited with RBI and on accrual of interest today stands at Rs.1503 crore.

The court directed the money to be distributed on a pro rata basis among over five lakh victims of the Bhopal gas disaster, who include the kith and kin of the dead and injured.

While claims worth Rs 86 crore have been settled already and another Rs 1100 crore distributed among the victims in one form or the other, the remaining amount lying in the court's custody has grown to Rs 1,503 crore because of accumulation of interest.

The bench directed the welfare commissioner, appointed under the Bhopal Gas Disaster (Processing of Claims) Act, 1985, to disburse the compensation on a pro-rate basis. The court has sought a report from the commissioner in three months.

The Court ordered the welfare commissioner of Bhopal Gas Relief Fund to file before it an account regarding the manner in which the money has been distributed.

The court posted the matter for further hearing after two months.

Ready for talks with other States too: People's War

HYDERABAD, JULY 18. The Communist Party of India (Marxist-Leninist) People's War has said that it is not averse to holding negotiations with other State Governments provided "they give up their repressive measures."

In an interview to three select journalists in the Nallamala forest tracts in Andhra Pradesh, Prakash, member of the outfit's Polit Bureau, said: "If other Governments replicate the initiative shown in Andhra Pradesh, we will also respond positively as we firmly believe in establishing peace."

Though the peace initiative in Andhra Pradesh is still in its formative stage, the State Government is making a determined bid to finalise the modalities in consultation with the three emissaries nominated by the PW. This has strengthened the demand for opening up avenues for talks on similar lines with other States. The PW and the Maoist Communist Centre of India (whose merger is believed to be imminent) have considerable presence in Orissa, Chhattisgarh, Jharkhand, Bihar, Madhya Pradesh, Maharashtra and West Bengal, and in a few pockets of Karnataka, Kerala, Tamil Nadu, Haryana, Punjab and Uttar Pradesh.

While the Orissa, Chhattisgarh and Karnataka Governments have responded cautiously to the demand for talks, the West Bengal Chief Minister, Buddhadeb Bhattacharya, has gone on record saying that he was closely watching the situation in Andhra Pradesh where the Congress has completely stopped counter-extremist operations to pave the way for talks. "We have a unified approach for rousing the masses. It all depends on the attitudes of the respective State Governments. If they come forward, we are ready for talks," Mr. Prakash said.

He, however, did not agree with the contention that the MCCI should take the lead and announce a unilateral ceasefire in other States, as it did in Andhra Pradesh in 2002. "We will not announce any such ceasefire, but if the Governments come forth with such an offer, we are ready." However, his party would have to consult the MCCI leadership before taking any decision in respect of Bihar and Jharkhand, he said.

In the case of West Bengal, he asked whether the State too was ready to bring about the same changes as Andhra Pradesh. "If so, we are ready for talks with them too."

Mr. Prakash demanded that the Andhra Pradesh Government order a judicial probe into "fake encounters" before it finalised the modalities for peace negotiations. "Though it is not a pre-condition for talks, we expect the Government to order a probe," he said. While the Congress Government appeared to be serious in holding talks, a section of police officials were making attempts to scuttle the talks' process, he added.

Asked whether the PW would give up arms if its demands were met by the Government, Mr. Prakash said that armed revolution was a non-negotiable factor in the proposed talks. "We can solve many people's issues through talks." The PW cadres carry weapons only for self-defence. "Why do you think there is no violence in Dandakaranya where we run a parallel administration? There people solve their own problems and there is no scope for violence. Only when the state supports the exploiting classes, people take to arms."
