Humane Killing!": Indian Judges Favour Lethal Injection For Death Penalty Bernama.com (Malaysian National News Agency), July 25, 2004, Sunday Indian Judges Favour Lethal Injection For Death Penalty NEW DELHI, July 25 (OANA/PTI) -- An overwhelming number of judges who responded to the Law Commission on ways to execute the death penalty favour lethal injection as an additional mode. The Law Commission's 187th Report on "Mode of Execution of Death Sentence and Incidental Matters", which was tabled in Parliament recently, analysed the responses it received from judges of different High Courts and subordinate courts. About 80 percent of the judges favoured an amendment to Section 354(5) of the Criminal Procedure Code, which provides hanging as a mode of execution. "All of the 80 percent judges who are in favour of amendment of Section 354(5) have suggested that administering lethal injection should be the other mode of execution of the death sentence," the report said. However, five percent of the judges suggested that apart from lethal injection, "shooting" could also be prescribed as an alternative mode of execution of death sentence, said the report presented to the Law Ministry by Commission Chairman Justice M.J. Rao. "Only approximately 19 percent of the judges are satisfied with the present mode of execution of death," said the report, without giving the number of respondents. The Commission had also sought the response of the judges on who should be given the discretion - the judge or the convict - to choose the mode of execution. "Forty-five percent of the judges opined that discretion should be given to the convict while 36 percent of the judges are of the view that discretion should be given to the judge in choosing the mode of execution of death the sentence," the report said. The Law Commission had also examined the question whether the convict, facing the death sentence, should have the right to appeal against the sentence which had been confirmed by the High Court before the Supreme Court. "Ninety-two percent of the judges have supported the view that there should be a statutory right to appeal to the Supreme Court in cases where the death sentence has been confirmed by the High Court. Only one judge of a subordinate court was not in favour of providing such right," the Commission said. However, to a specific question from the Commission, most of the judges felt that there was no need for constitution of a five-judge bench of the Supreme Court to hear an appeal filed by the convict challenging the High Court verdict. "Fifty-one percent of the judges have given their answer in the negative, while 41 percent of judges are of the view that cases relating to death sentence should be heard and decided by a bench of not less than five judges," the report said. -- OANA/PTI --------------------------------- #2 DELHI's Daily Dose": A Murder, Robbery And Rape IANS, July 25, 2004, Sunday Delhi witnesses a murder, robbery and rape everyday New Delhi, India: Someone gets murdered or faces a violent attack and a woman is raped everyday in the national capital, says a report prepared by Delhi Police. The report analyses both heinous and non-heinous crimes registered by Delhi Police in the past six months. According to the report, police registered 269 rapes, 240 murders, 235 murderous assaults and 235 robberies between January and June this year. These figures suggest that everyday at least one case each of murder, robbery or attempted murder was registered in New Delhi in the past six months. The situation was not very different in 2003, when police registered 490 rapes, 485 murders, 407 cases of attempted murder and 441 robberies across the city. Though the report points to an overall decline in crime, it makes it clear that cases of burglary and theft are on the rise. According to records a total of 68,891 cases of burglary and thefts were registered since 2001 till June 30 this year. How serious the situation is can be gauged by the fact that in every 24 hours, 56 cases of theft or burglary were registered in the capital in the last six months. A total of 10,150 burglaries and thefts have been registered so far this year. Last year, the police had registered a total of 17,442 cases of thefts and burglary or 47 such cases everyday.
