Sati: HC slaps notices on Vasundhara govt EXPRESS NEWS SERVICE Posted online: Saturday, August 07, 2004 JAIPUR, AUGUST 6: The Rajasthan High Court today issued notices against the Vasundhara Raje government, one of her ministers and 10 others, after admitting a writ petition challenging the acquittal of 11 accused of ??????Sati glorification??™??™ in the Roop Kanwar case. Judges S.K. Keshote and Anup Chand Goyal admitted a petition filed by 12 women??™s groups, which have challenged the lower court??™s judgement, saying it misinterprets the meaning of ??????Sati glorification??™??™. They have also asked for action against government witnesses who turned hostile. On January 31, a special court had released many Rajput leaders, including Parliamentary Affairs Minister Rajendra Rathode and Vice-President Bhairon Singh Shekhawat??™s nephew Pratap Singh Khachariawas, due to lack of evidence. Pronouncing the final judgement in four cases ??” registered in Neem Ka Thana, Kotputli and Jaipur ??” the special court had ruled in favour of the accused, saying the prosecution had failed to produce evidence indicating Roop Kanwar had committed Sati. Further, the court had stated that since the main case against Kanwar??™s in-laws was not registered under the Sati Prevention Act, and was being tried as a murder trial, the question of glorification of sati did not arise. Moreover, the glorification cases were registered under the Sati Prevention Act, which became a law later, and hence did not cover this case. Following the judgement, the BJP government had dithered over filing an appeal. It was after the timeframe to file an appeal expired that the writ petition was filed independently. ??????The government appeals in all kinds of cases, even robberies,??™??™ argues activist Kavita Srivastav. ??????They did not appeal because its own people were involved. Officially, they say, they did not find it worthy of appeal. But the fact is that there are vested interests involved and the Rajput lobby also has a say.??™??™ Education Minister Ghanshyam Tiwari, however, says: ??????After the judgement, we referred the case to the Law Department. It was their opinion that since the witnesses had changed, it was not advisable to go into appeal. Now, the government will review the new situation and take a decision accordingly.??™??™ On September 4, 1989, Deorala village had hit the headlines when a young, educated woman set herself ablaze on her husband??™s pyre. Kanwar??™s in-laws were tried for murder and found not guilty by a court in Neem Ka Thana. The case is now pending before the courts in Jaipur. Besides the murder case, the police had also issued challans against 16 people, accusing them of glorifying Sati. The low-profile RSS men will be the live link between the parent organisation and it??™s political wing. They include Venugopal Reddy, V. Satish, Mukundan, Ram Pyare Pandey, Saudan Singh and Prasanna Mishra. More appointments in the category are likely since all the zones were not covered today. The BJP also announced its list of new prabharis (central leader in-charge) of states, of which the names from Uttar Pradesh were the most significant. Keen to revive in UP and stem the factionalism in the state unit, plum assignments have been given to the leading troika of central leaders ??” Kalyan Singh, Rajnath Singh and Kalraj Mishra. Kalyan Singh has been made prabhari of UP, while Rajnath Singh and Kalraj Mishra have been given the charge of two major states each. Rajnath will now look after Chhattisgarh, in addition to the election-bound Jharkhand state, while Mishra has got both Rajasthan and Delhi. Although Rajnath Singh and Mishra will not be involved in the day-to-day affairs of their home state, the ??????respect and responsibility??™??™ given to them is aimed at beefing up their respective support bases in UP, sources said. Since Rajnath Singh is regarded as the party??™s key Thakur leader in UP and Mishra belongs to the Brahmin old guard, their elevation is also part of the strategy to regain the support of upper castes who largely abandoned the BJP in the last elections, they added. The newly-appointed state president, Kesri Nath Tripathi, is arriving here tomorrow and will hold discussions with party chief Venkaiah Naidu and also meet A.B. Vajpayee and L.K. Advani. Tripathi will be briefed on the decisions taken at the Goa Chintan Baithak on how to revamp the organisation in UP, Naidu said. Pramod Mahajan was put in charge of Maharashtra but Arun Jaitley was given charge of Madhya Pradesh, in addition to Bihar. A number of former ministers have also been drafted into the organisation. They include Shahnawaz Hussain (Orissa), Jaskaur Meena (Punjab), Rajiv Pratap Rudy (Sikkim) and Swamy Chinmayanand (Arunachal Pradesh). Former RSS pracharak Seshadri Chari has been made in-charge of Uttaranchal.
