(Rediff News/PTI, September 13, 2004, Monday) http://in.rediff.com/news/2004/sep/13beng.htm --------------------------------------------------- #2 DEATH SENTENCE: 'Minor' Rapist-Killer May Escape Noose Indiatimes.com, September 13, 2004, Monday 'Minor' rapist-killer may escape noose KOLKATA: Gautam Biswas may escape the fate of Dhananjoy Chatterjee. The rapist-murderer, out on bail, was apparently a minor when he committed the crime. The case was reopened recently after the victim's father Trilochan Maity, drawing belief from the execution of Dhananjoy, moved Calcutta High Court (which had granted Biswas bail on August 12 1992). "Biswas could not be tried at a sessions court because he was a minor. The trial was not fair. The law clearly states that a minor has to be tried by a juvenile court and he cannot be sent to jail but to a reformatory," said Joymalya Bagchi, Biswas's counsel in high court. He was speaking at a press conference organised by the Manabadhikar Suraksha Mancha (MASUM). Sept 02 : A four-year-old girl is allegedly raped by her cousin at Khaddi Mohalla in Varachha, when she had gone to relieve herself. August 29: A 10-year old girl is allegedly raped by her maternal uncle in Ahmedabad. August 25 : A seven-year-old girl is allegedly raped and then strangulated to death at the banks of Tapi river in Gandhangar, when she went to relieve herself. SURAT/AHMEDABAD: On Wednesday, Surat almost hit the notoriety charts with the fourth case of rape of a minor in the fortnight. Except, that nobody lodged a complaint even as the five-year old girl is still undergoing medical examination. The hanging of Dhananjoy Chatterjee and the death penalty on Kishan Marwadi closer home, notwithstanding, cases of minors getting lured away by their cousins, uncles or neighbours and ending up as rape victims continue to haunt Surat and Ahmedabad. Surat saw three such cases in the past fortnight alone, sending shock waves and forcing the police and the social organisations to sit up and ponder the unholy trend that was ruining young lives.
