1) NHRC Indicts Modi Govt Once Again

NEW DELHI: Gujarat government has been indicted by the National Human Rights Commission (NHRC) once again. Though unrelated to the 2002 violence, the commission has rejected the state government's plea that interim relief to the family of a victim of custodial death be kept in abeyance till criminal proceedings get over.

The commission has asked the state government to pay the interim relief of Rs 1 lakh immediately to the family of deceased Haji Mohd Nabuji Tentwala, who died in police custody in 1995. NHRC has also asked for a compliance report within four weeks.

According to sources, what came as a surprise was the fact that state government, despite acknowledging the human rights violation, took the stand of not paying the interim relief and requested the commission to withdraw its showcause notice.

The NHRC said, "In the face of these facts, the stand of the government of Gujarat becomes logically unacceptable and legally untenable... By no stretch of imagination could it be argued that the award of 'immediate interim relief' has to be dependent upon the strict establishment of criminal liability after a full dress court trial."

2) Medical expert grilled by defence in Best Bakery case

MUMBAI, OCT. 20. N.V. Champaneria, assistant director, Forensic Science Laboratory, Baroda, today told the sessions court during the Best Bakery retrial that there was no residue of petroleum or hydrocarbon product found on the
samples taken from the site of the incident.

Fourteen people were killed when the Best Bakery in Baroda was set on fire by a mob in the aftermath of the Godhra incident. Mr. Champaneria told the court that the exhibits failed to show petroleum samples after chemical tests. The absence of a petroleum product could be due to many reasons, including improper collection of samples or spraying of water. He said the samples might not have been collected from the correct place. To questions from the defence, he said the tests were negative.

Bone examination

The defence also grilled Shabbirali Syed, professor and head of department of anatomy, who had examined the bones collected as evidence from the site of the Best Bakery. Yesterday, Dr. Syed, who is now posted at PDU Medical College, Rajkot, submitted his certificate after he was asked to examine samples of charred bones collected from the site of the Best Bakery carnage. The defence had noticed a discrepancy between what Dr. Syed submitted and the documents made available to the court along with the charge-sheet.

But today Dr. Syed explained the full procedure involved in the matter, saying that notes were made initially and kept along with the evidence. A photocopy of these notes was also made in case the original was lost. The final certificate was prepared based on the original note and the facts were consistent with that. But, he said, there was no need to make the changes in the form of corrections or additions in the original note. To a question from the defence, he agreed that the changes were not signed by anyone nor were the dates written when the changes were made.

Defence counsel, Adik Shirodkar, put it to Dr. Syed that the investigating officer, Mr. Kanani, did not approve of his original examination report and he wanted the changes made. Mr. Shirodkar also said that Dr. Syed had tampered with the certificate, which Dr. Syed denied. The issue of contention is that in the notes, Dr. Syed had written that some of the bones belonged to a person over 24 and in the final certificate this was changed to over 18 years of age.

Yesterday, Dr. Syed had identified the samples of bones collected from the site and said that they belonged to two persons, one of them aged over 18, based on a piece of the upper jaw, which was part of the evidence.

NAGALAND: DURGA'S ATTIRE IN KOLKATA IRK NAGAS

Dimapur, Oct 20: Leading Naga based social organisations have strongly condemned the way one Durga Puja pandal in Kolkata has used the Naga attires to dress up the goddesses and idols.

A Nagaland based newspaper has reported in today??™s edition that the frontal Naga organisations while condemning the Ajeya Sanghati, Kolkata, for its "deliberate and malicious attempt" in distorting the Naga people and their culture by dressing certain statues in Naga attires at a Durga Puja pandal in Kolkata, some frontal Naga organizations of Nagaland demanded an immediate unconditional apology from the Ajeya Sanghati to the Naga people.

The daily newspaper reported that while expressing deep resentment over the "motivated attempt aimed at instigating the good relationship the Nagas have with other diverse peoples", the Naga organizations in a letter addressed to Ajeya Sanghati also demanded that the Naga attires be immediately removed from the statues as corrective measures.

Further reporting the Nagaland newspaper said that the organizations in a press communiqu?© jointly issued by leaders from the Naga Hoho, Naga Students??™ Federation, Nagaland Baptist Council of Churches, Naga Mothers??™ Association and Naga People??™s Movement for Human Rights appealed to the Nagas to be cautious of communal attempt by such "cheap" roadside show.

2) IM talks in Bangkok from today

Bangkok, Oct 20 : Hoping to take the ongoing peace process forward, Indian Government and Naga outfit NSCN (IM) will discuss some key outstanding issues during a crucial round of talks beginning here tomorrow.

Indian delegation to the talks would be headed by the Centre??™s interlocutor K Padmanabaiah while Naga leader T Muivah will lead the NSCN (IM) side.

"Some Important issues may be touched at the meeting, expected to last two days," a senior member of the NSCN (IM) based here told PTI.

He said Muivah is already in the Thai capital for the talks.

"We are to go to India for the next round of talks and that will depend on the outcome of this round of talks to begin tomorrow," he said.

The talks now aim at extending a seven-year-old peace process between the Government and the National Socialist Council of Nagaland (NSCN) whose leaders live in Thailand and The Hague.

The NSCN wants an independent homeland for three million Naga hill people in its plan for a greater Nagaland carved out of Naga dominated areas in Nagaland, as well as neighbouring Manipur, Assam and Arunachal Pradesh. India has not agreed to this plan.

A truce between the NSCN and New Delhi was agreed in 1997. It has held and been extended on several occasions.

After extension of the ceasefire for another year in August last following discussions in July, both sides were meeting once again to carry forward the dialogue process amidst Centre??™s assertion that Naga leaders should come to India for political talks.

Among others, contentious issue of integrating Naga inhabited areas might dominate the parleys against the backdrop of Naga NGOs??™ sustained campaign for bringing such areas under a single administrative set up.

The demand has been opposed by the neighbouring states of Manipur, Arunachal Pradesh and Assam.

The Communist Party of India (Maoist) has reportedly launched a campaign in the rural areas to strengthen its cadre from the grass-root level by constituting village committees with representations from all castes. Militants of the naxalite group have been entrusted with the job of constituting village committees. Naxalites belonging to the CPI (Maoist) have also revived its contacts with the surrendered naxalites and are planning to re-induct them into the party after a thorough screening, according to reports.Taking advantage of the truce period, naxalites have intensified their mass recruitment process in the interior villages of the district. Naxalites have revived its frontal organisations including Sikasa (Singareni Karmika Samakya), Akasa (RTC karmika samakya), RSU (Radical Students' Union), RYL (Radical Youth League) and Viplava Rythu Coolie Sangham. 11) Villagers occupy surplus land

NIZAMABAD, OCT. 20. The landless poor of Gadkole in Sirikonda mandal under the leadership of the CPI (M-L)--New Democracy have reportedly occupied about 400 acres of the Government and surplus land for cultivation in the village.

According to reports, 200 persons descended on the land, including the reserve forest and surplus land, and pitched red flags there. They also cleared bushes and trees to make it cultivable in the last two days. The Sirikonda SI, D. Krishna, said that neither the revenue nor the forest officials lodged any complaint regarding the land occupation.

12) Clear the air: BJP

Rajasekhara Reddy, make public the details of the first round of the talks held between the State Government and the naxalite outfits - the CPI (Maoist) and the CPI(M-L)Janashakti. Addressing a press conference here, the former Union Minister, Ch. Vidyasagar Rao, and the BJP State general secretary, K. Laxman -- accused the Government of lacking in accountability with Dr. Reddy and the Home Minister, K. Jana Reddy, making conflicting statements during the talks.
