Additional sessions judge Chander Shekhar also imposed a fine of Rs 10,000 each on convicts Manohar Giri alias 'Baba' and his follower Virender (27) after holding them guilty under section 76 (2)(G) (gang rape). The court acquitted a third accused Baggilal due to lack to evidence while another accused Puran is absconding. "They are guilty of a gruesome act... Such an act of bestiality deserves stringent punishment," the court said, adding that "a murderer destroys the physical frame of the victim, but a rapist degrades the soul of a helpless female in consequence of which the victim suffers and dies every day". Acting on the complaint of the girl's father registered at Anand Parbat police station on February 13, 2001 that his daughter had gone missing since two days prior to that, Baba, Virender and Baggilal were arrested on February 17 that year when the 15-year-old girl returned and narrated her nightmare to the police. The victim said her parents respected baba and used to send her to his place to deliver tea. On one such occasion, 2-3 years prior to the incident when she had gone to give him tea, he made her smell something as a result of which she fainted. When she woke up, she found herself nude and baba was putting on his clothes. Then the accused took her nude pictures and started blackmailing her saying they would show it to her parents. The six killed police officials included superintendent of police K.C. Surendra Babu. Sources said guerrillas of the Communist Party of India (Maoist) were irked by the brutal beating up of a woman Maoist at the Kajra railway station by the railway police. Soon after the incident, the guerrillas attacked the Kajra railway station and looted four rifles in broad daylight on Jan 4. They also injured five policemen. In the wake of the open challenge to policemen, a police team led by Babu raided several villages suspected of being Maoist hideouts. The team was returning from the operation when the rebels triggered the blast, killing Babu and five others. The killing shocked the state's top police officials, as Munger does not figure in the hot list of Maoist-affected districts in Bihar. "Unlike Gaya, Jehanabad, Aurangabad, Arwal, Patna or Nalanda, Munger is not considered a Maoist hit district but killing of the police superintendent and five others compelled police headquarters to probe what led the Maoists to act like this," sources said. - IANS http://www.newindpress.com/NewsItems.asp?ID=IEP20050107074947&Page=P&Title=States&Topic=0& ------------------------------------------------------------ New Indian Express, January 08, 2005, Saturday 'Warfare' training centre for cops coming up IANS RAIPUR: Plans are afoot to set up the nation's first 'warfare' training centre for the police force in Chhattisgarh, Director General of Police (DGP) O.P. Rathor said here on Friday. The school, to come up in the Kanker forests of the Bastar region, will impart latest tips and forest survival techniques to enable police to deal with extremist outfits and Maoist guerrillas, he said. "It will be the country's first institute teaching survival techniques and latest police methods to combat the Maoist menace," the DGP said. The Chhattisgarh government has approved of the plan. The first batch of 60 cops will begin training within three months in Kanker district, 220 km from here. "The number of trainees will be gradually increased with each batch comprising 200 finally," Rathor said. Neighbouring states like Jharkhand, Orissa, Andhra Pradesh, Uttar Pradesh, Madhya Pradesh and Maharashtra are welcome to send their police personnel for training, he added. http://www.newindpress.com/NewsItems.asp?ID=IEP20050107075114&Page=P&Title=States&Topic=0& ------------------------------------------------------------------- 3) ASSAM: Mistaken Identity: Cops Shoot Down Army Major, Soldier New Indian Express, January 08, 2005, Saturday Mistaken identity: Cops shoot down Army major, soldier GUWAHATI: In an incident that underscored the poor coordination between security agencies, an Army Major and a jawan were gunned down by Assam Police, which initially described them as ULFA militants. After the identity of the two men became known, the police first claimed its personnel had fired in self-defence and later that the Armymen had been killed by militants. State Home Secretary B M Majumdar said he was awaiting a report from Dibrugarh district, where the incident took place. Meanwhile, the details trickling out showed a complete lack of communication between security agencies, although they are required to coordinate anti-insurgency operations. The police had received a tip-off that some militants were expected to visit Samukoni village, some 20 km from Dibrugarh, said the district's Additional Superintendent of Police, Ashim Swargiary. The policemen were apparently waiting for them when Major Mukesh Chaurasia and Sepoy Bikash Senchowa showed up. Both were working for the Military Intelligence wing at the 2 Mountain Division headquarters at Dinjan near Dibrugarh. The policemen in plainclothes had stationed themselves inside a couple of houses in the village. They opened fire soon after the Armymen-also in civilian clothes-arrived in a car. The police claimed militants had been gunned down and came out with a fresh version only after the identity cards of Major Chaurasia and Sepoy Senchowa were found on them. Swargiary then claimed the two men had opened fire first and his commandos had merely retaliated. The police have also claimed to have recovered two 9 mm pistols and some ammunition from the dead men. Later, when their identity was established beyond doubt, Assam Police DIG Bhaskar Jyoti Mahanta insisted they had been gunned down by militants. Home Secretary Mazumdar told this website??™s newspaper that initial reports suggested that neither the police nor the Army was aware of each other's presence in the village. Meanwhile, the body of Major Mukesh Chaurasia, who had only recently rejoined duty after a long leave, was sent back to his home state, Bihar. Jawan Bikash Senchowa was cremated in his village at Moran. While there have been reports in the past of innocents being gunned down in counter-insurgency operations because of mistaken identity, this is the first case of a senior Army official being killed in this manner. The Army Headquarters is ordering an inquiry into the incident. Questions will also be raised about the working of the Unified Command Structure, which is supposed to ensure coordination between various agencies. The show-cause notices were issued to police officials, including the Thalassery DySP, on charges of suspected illegal detention and third-degree methods on two prisoners at the Thalassery police station. The police officials against whom the notices were issued are DySP P.Prakashan, Thalassery circle inspector Vikraman, sub-inspector Sukumaran and two probationary sub-inspectors. The rights commission also sought explanation from medical officer Dr Girija for allegedly helping the police to create fake records. They have been directed to give their explanation within 14 days. The issue came up before Commission acting chairperson V.P. Mohankumar during his visit to the Kannur Central Prison in November last year. A remand prisoner Sandeep John told the Commission that two others, the police was detaining Jose Mathew and Pavanan, who were taken into custody by the Thalassery police. The Commission subsequently conducted a surprise inspection at the Thalassery police station on December 18 and found Jose and Pavanan detained in the lockup room. Pavanan told the Commission that he had been detained since October 31 and was assaulted by the police. Both of them also had marks of injuries on their bodies. The Commission verified the station records and found that there were no records on the two being held in custody. The Commission directed DySP Prakashan to arrange the necessary treatment for Jose at the Thalaserry Government Hospital. Dr Girija told the Commission, which visited the hospital the next day, that Jose was not brought to the hospital. There were also no entries in the hospital records regarding Jose. The Thalaserry District and Sessions Judge, who followed up the issue on the request of the Commission, found that Jose was taken to the hospital on December 18 and that he was examined by the medical officer. Jose Mathew and Pavanan were produced before the Thalassery Judicial Magistrate Court on the night of December 18 stating that they were arrested on that day.
