 27th February 2005, Authoritarian suppressed Subansiri valley??™s democratic right: Urgent support and action needed

 

Constitution of India has granted right to express to its citizen and it is the responsibility of the state machineries to protect and ensure that every citizen enjoy the right to fullest. Equal opportunity to participate and express is the basis on which democracy sustains is accepted through out the world and violation of the same should be condemn collectively to stop repetition is agreed upon internationally and nationally on hundreds of resolution and declaration both by state as well as civil society. The matter should get more focus if the victims are women who were socially in a disadvantageous position to express themselves and very recently coming up to be part of the decision making process and express their choices, priorities etc.

Keeping citizens in dark and ignoring popular sentiments in the name of national integrity and nation building process for expropriation of resources of north eastern India martyring the choices and interests of the indigenous and tribal population of the region is on practice since independence. The recent understanding of the North easterners is that apart from blaming the state machineries it should also considered as historical mistake committed by the people of the region who have ignored the resource expropriation process of the mainstreamers although out of ignorance are now determined to be part of every decision that affects their life in the name of nation building process.

Unrest situation prevails in the Subansiri valley out of construction of 2000MW lower subansiri dam. Although Government and NHPC have managed to keep the people in dark on issues related to life and livelihood of the valley dwellers propagating utopian assumptions but situation has changed through intervention of civil society organizations. People have started voicing against the structural denial of rights of the valley people to be informed on the on goings and future dam imposed human miseries. The people??™s concerned on the issues has started gaining momentum and on the context Subansiri Songrakshak Naari Sontha??™ a women??™s group floated recently organized a public gathering on 27th Feb 2005 at Moharicamp Playground, Subansiri valley for sensitizing on the lower subansiri related human concerned issues of the Subansiri valley dwellers to ensure effective participation of every citizen on the lower subansiri daming process. This democratic effort has been curbed systematically by
 the state administration under influence of NHPC.

On 26th February 2005:

It was 20.00 hrs of 26th February 2005 the gogamukh police seized the vehicle using by ???Subansiri Songrakshak Naari Sontha??™ (SSNS) for publicity of the gathering along with the person in responsibility for publicity.  

Followed by taking Ms Kalpana Hazarika secretary ???Subansiri Songrakshak Naari Sontha??™ along with two other co-workers, both women into police custody. In the moment Ms Kalpana Hazarika was in a theater house.  

In the police station they were enquired on the gathering, accused them of disseminating distorted information causing public terror and forced them to withdraw the public gathering threatening not to release the vehicle along with the person otherwise. The tremendous psychological pressure compelled the Ms Kalpana Hazarika to act accordingly. They were released at 21.45, 26th February 2005.

  On 27th February 2005:

The women could not accepted violation of their democratic rights. They approached the Officer-in ??“charge, Gogamukh police station and asked permission to organize a general meeting. They expressed concerned that a huge chunk of citizens has been informed who are definitely turning up so how can retreat. At this the officer-in charge permitted them to held the meeting at far side of the NHPC approach road and finish the same within a span of 0.30 hrs.(!!!!!!!!).

Here PMSV and Intervened in to the scene. We tried to take the ball into the court of office of the Deputy Commissioner, Dhemaji but being Sunday we failed.  Sentiments of the people reflected that the meeting should be held and have been accomplished accordingly. The meeting which was addressed by 2 members of PMSV vehemently condemned the state imposed violation of democratic right of Subansiri valley people and resolved the following points for immediate action

(1)   It has been decided that if LICI do not refrain from funding NHPC then no agent of LICI will be allowed to enter Subansiri valley. Sit-on- dharna will be organized at the office of LICI in Dhemaji and North Lakhimpur District(2)    Memorandum seeking justice against authoritarian suppression of democratic right to express of Subansiri valley people will be sent to NHRC, AHRC, chief Minister of Assam, Local MLA, local MP, Deputy Commissioner, Dhemaji and Superintendent of Police, Dhemaji.

(3)   The people of Subansiri valley will observe the Women??™s day (8th March 2005) and rivers day (14th march 2005) to express and declare indigenous and tribal people??™s choices and priorities on utilization of region??™s resources.  

4)   A foot march will be undertaken to the NHPC office to submit a memorandum to the general manager, NHPC to convey valley people??™s resentment on lower subansiri project.

 Seeking solidarity:

The people??™s movement in Subansiri valley initiated by CSO (PMSV, SSNS) of Subansiri valley has been accumulating people??™s concern and acceptance. At this high time we seek solidarity of every concerned citizen and groups in terms of human and financial resources in favor of PMSV and SSNS  to ensure further action in a strengthen and conducive environment to assert Subansiri valley people??™s choices and priorities.

NHPC looses 5 crore per day due to BHEL in Subansiri Dam.

NEW DELHI, Feb 27 ??“ The imbroglio over the Rs 1,625-crore contract of Subansiri (Lower) Hydro-electric Project continues, with National Hydro-electric Power Corporation (NHPC) threatening to blacklist the Bharat Heavy Electricals Limited (BHEL). The fight between the two PSUs, as reported earlier in this newspaper, meanwhile, has attracted the attention of the Prime Minister??™s Office (PMO) and NHPC chairman Yogendra Prasad along with top officials were summoned to explain the award of the mega-contract to the consortium of Alstom Power Hydraulique, France and Alstom Projects India Limited.

The PMO??™s intervention came after the Left party MP, Dipankar Mukherjee and Minister of State for Heavy Industries and Public Enterprises, Santosh Mohan Dev, cried foul seeking a probe into the award of the contract to the French consortium in violation of norms. The developments, however, left the NHPC fuming, with top officials confirming that moves were afoot to blacklist BHEL for misrepresenting facts and failure to fulfil norms.

The NHPC??™s argument was that award of the electrical and mechanical work package to Alstom had been made after thorough scrutiny of the offers of the bidders and strictly adhering to the relevant provisions of ???instruction to bidders (ITB)??™ stipulated in the bidding document. On the objections raised over method of evaluation of bid price, the NHPC claimed that it was in line with the judgement of the Supreme Court and established laws.

???Some arithmetical discrepancies between the ???unit price??™ and ???total price??™ that were noted in the price bid offer of BHEL-Marubeni joint venture have been corrected strictly in accordance with the ITB clause 22.2,??? a top NHPC official claimed briefing newsmen. The news regarding making BHEL as L2 bidder after arithmetical correction is wrong and away from fact. Even before incorporation of the arithmetical corrections of price bid according to relevant clauses, BHEL-Marubani was the L2 bidder. ???The evaluated bidder was the consortium of Alstom and as such alleged favours shown to any bidder by NHPC was totally misplaced,??? the official claimed.

The NHPC has further clarified that the opinion of Solicitor General of India was based on selective information furnished to him without reference to any case law or viewpoint of NHPC. Adopting a similar strategy, the NHPC has also procured an opinion from the Additional Solicitor General of India, B.Dutta, who said that evaluating the bids as per clause 22.2 of the ITB, NHPC applied the manner of correction provided in the said sub-clause and arrived at a total price.

The matter of consideration in evaluation of bids particularly international tenders on competitive basis stands concluded by the Supreme Court judgement reported in 2001 in West Bengal State Electricity Board Versus Patel Engineering Company Limited case. ???In light of the principals laid down therein I do not find any infirmity in the evaluation of the bids by NHPC,??? he certified.

NHPC officials claimed that cribbing by BHEL was not in good taste and was going to lead to delay in execution of the 2,000 MW project in Arunachal Pradesh. ???WE have already started civil work and delay in execution of the electrical and mechanical would cost NHPC Rs 5 crore a day, he asserted.

Trouble started for NHPC when CPI-M Rajya Sabha MP Dipankar Mukherjee wrote to the Prime Minister levelling allegations about the mode of evaluation of the bids of the two major contenders. He alleged that the evaluation was manipulated by NHPC to favour the French consortium.

Mukherjee cited the Solicitor General??™s opinion, which observed that NHPC??™s action was entirely impermissible and unreasonable and would make no sense of the bid. ???If NHPC acts in the manner that it proposes to do, such action would be entirely unreasonable, arbitrary and violation of Article 14 of the Constitution,??? the Solicitor General had commented. NHPC official countered BHEL by arguing that if the PSU was so sure about the legal strength of its case then what has prevented it from moving the courts
