[1] From: yogi sikand <ysikand@yahoo.com Date: Sat Jul 2, 2005 Subject: ALL INDIA MUSLIM MAJLIS-E-MUSHAWARAT: On The Imrana Rape Controversy ALL INDIA MUSLIM MAJLIS-E-MUSHAWARAT D-250, Abul Fazal Enclave, Jamia Nagar, New Delhi - 110 025 Ph: 2632 6780 Fax: 2632 7346 Email: muslim@... 2 July, 2005 STATEMENT AIMMM Condemns Political Exploitation of Imrana Case by BJP Criminal Case Must Take its Course under Law of Land Personal Law Aspect should be Decided by Consensus among Various Schools of Muslim Law Media should not Blow up Individual Incidents to Malign Islam Muftis Should not Issue Fatwas on Live Questions on Request from Strangers and without Due Investigation New Delhi, 2 July, 2005: Shri Syed Shahabuddin, President of the All India Muslim Majlis-e-Mushawarat (AIMMM), has issued the following Statement :- "The All India Muslim Majlis-e-Mushawarat (AIMMM) condemns the political exploitation of the Imrana case by the BJP to promote its long-cherished agenda of religious assimilation of the Muslim Community through imposition of a common civil code in substitution of its Shariat-based Personal Law. The AIMMM considers this move totally illogical and misconceived because no civil code can eliminate incestuous relationships from the Society and points out the fact that many such cases in the Hindu community are reported off and on, though it violates Hindu Code. The AIMMM would like to clarify that the Imrana case has two aspects. The criminal aspect, the alleged rape or molestation, must be dealt with under the law of the land. Law must take its course and the culprit, if found guilty, should be awarded the maximum sentence. On the personal law aspect i. e. on the question whether the Nikah between a Muslim woman and her husband stands dissolved after a rape by her father-in-law, different schools of Islamic jurisprudence have different opinions. In any case, a 'fatwa' is an opinion and not a judicial verdict. The All India Muslim Personal Law Board is expected to hold a meeting soon to reach a consensus, keeping in view the circumstance of the case and the demand of justice which is one of the basic principles of Islam. The AIMMM requests the mass media not to blow up individual cases in the interest of inter-faith understanding or read a stray fatwa as a final ruling under the Shariat. The AIMMM is not aware whether Imrana or her husband has even approached the Dar-ul-Uloom or the local Dar-ul-Qaza. It, therefore, appeals to the Muftis to refrain from issuing 'Fatwas' on live and sensitive situations unless approached by the parties concerned and without investigating the circumstances." ------------------------------------- [2] From: Parvez Jamasji <parvez1942@yahoo.com> Date: Sat Jul 2, 2005 9:07am Subject: How our FREEBOOTING Netas Impoverish us + THE SEASON OF ARIAL SURVEYS > Earlier Posts parvez1942 Super Cyclones, Annual Floods & Draughts; add to them Quakes & now Tsunamis, are in themselves a heavy drain on the Exchequer. Aerial Surveys by the Netas & their entourages to observe the obvious, only adds to the cost to the Tax Payer & are of nuisance value to those trying to mitigate the misery of the victims.What is the outcome of these Arial Surveys? Have they resulted in ANY planning to control or mitigate the blow of these disasters on the victims, year after year ?? It is a ritual, come Floods or Draughts & the Netas take to the Air for surveys & then tell the country the situation is grim, which the country already knows. The already burgeoned Taxpayer under Heavy taxation, compare the price of POL in India & its neighbouring countries; is asked to pay up for the damage caused by the Natural Disaster & also for the expenses of Aerial Surveys. Apathy, sloth & sheer inaptitude combine to derail the best of Disaster Management Plans. The "Steel Frame" of the Administration rusted & rotten to the core is only able to put its arms up in helplessness & "Call out the Army in aid of civil power" What happens & its only a matter of time, when the Military realising that it not only is there to Defend the country but also to take on the work of the the IAS Sloth, starts behaving similarly ???
