Act. The strike continued in the form of a sit in from 11.30 a.m on 6th to 4.00p.m on 8th January. The management amased police to evict the workers. The Militant workers occupied the 'LPG Bullet' area and made it known that if the police lathi-charge or fire them they will blow up the whole premises using the LPG Bullets which would have killed instantly all those who are on the premises. This has saved the situation from going out of hand. The management then denied food, water and toilet facilities to the workers. The 1400 workers (all below 28 years) with stood the pressure. The management then declared a lockout on 8th January 2006. The leaders of Centre of Indian Trade Unions (CITU) ascertained the opinion of the workers sitting in the 'isolated' factory and the workers were advised to come out after the lockout, they came out at 4.p.m on 8th January 2006. The Management got a conciliation started on 6th itself. Our forthright stand for withdrawal of the dismissal orders made the conciliation officer to suggest to the management representatives to keep the 'Dismissal Orders' in abeyance. The union concurred with the suggestion of the conciliation officer and indicated that the strike will be withdrawn, simultaneous to the order of dismissals being kept in abeyance. The Management got the conciliation adjourned to next day i.e., 7th. But they sent a fax message to the conciliation Officer falsely stating that they are confined by the workers as their way is blocked by the workers. We made the Conciliation Officer to get in touch with the police inside the plant and got the truth that the management is free to go to the conciliation. Upon our suggestion the C.O then sent a fax to the management exposing their lie and indicating 'suggestion' and union's preparedness to call off the strike. The workers' resolute stand, force and restraint exposed the management and foiled their game. CPI(M) leaders locally helped to pressurize the Government to ensure that food and water is provided to workers. The next day i.e., 8th January the management declared a partial locked out of the plant. The lockout is partial applicable only to unionized in essential workers. The management plan is to restart production using other workers i.e., supervisors and trainees etc., On 8th the Management after the lockout went on record in TV interview that they will attend the conciliation meeting on 9th. However they did not turn up alleging falsely that violence is going on the City created by the workers. The allegations of violence was totally false. The management engaged goondas (Janatha/Congress followers) of the locality to beat up media persons, to throw stones at passing vehicles etc., to allege violence. Over a thousand workers assembled at the 'Karmika Bhawan' the Labour Commissioner Office from 2.00p.m on the 9th and they remained steadfast in the biting cold without any protection of warm clothing braving all privations, till the CITU leaders decided to change the course of the struggle today. The Management refused to attend the conciliation meeting on 9th alleging violence etc. They sought two weeks time. The Labour Commissioner Mr.K.S.Manjunath and Deputy Labour Commissioner Mr. Hittangi granted three days time to the management until 11.30 a.m. on 12th January 2006. Protesting against this the Toyota workers and workers from MICO and other plants did a day and night sit in on 9th and 10th. Com.M.Meenakshi Sundaram CITU State Treasurer stayed with the workers continuously keeping in touch with V.J.K, General Secretary of Karnataka State Committee of CITU and others. They got vacated the Labour Office by 4.00p.m on 10th after CITU leaders and CPI(M) leaders including Polit Bureau Member Com. K.Varadarajan addressed them. The workers will reassemble in a nearby park on 12th and decide further course of action. The union/CITU demands that the Government immediately: i. to order under section 10B (Karnataka Amendment) of I.D.Act to keep the Dismissal Orders in abeyance; ii. to order under Sec 10B to restart production in the P.U.S. employing all the workmen who were on rolls as on 6th January 2006 iii. to refer for adjudication the justifiability of the strike/lockout iv. to prohibit the lockout v. to prosecute the management for violating Sec.33 of ID Act & vi. to sanction all applications for prosecution for violating certified standing orders, Contract Labour Act, and Reg. Unfair Labour Practices. Separate note on past history is sent separately. Com.Meenakshi Sundaram who participated in the Hongkong protest against WTO has established contacts with Toyota Plants' Unions in Phippenes etc. CITU Centre has also written Zenroren, Japan for solidarity. end ------------------------------- [3] From: Regi P George <george_regi@yahoo.com> Date: Thu Jan 12, 2006 Subject: mindless industrialization caused tribals killing in Orissa ORISSA MAYHEM-Brutal killing of tribals opposed to mindless industrialization Two days after the black Monday which took life of 14 innocent tribal including a school kid, a mass cremation held at Gobarghat village just 1 kms away from the spot with pain, sorrow & condolence ruled all over. The death of innocent tribal reverberated in the sky with tens of thousands tribal gathered to rally round condemning the brutal killing and sending a strong message to Govt. not to adopt this heinous, barbaric attitude otherwise tribal will be in the streets all over the country. Though the government of Orissa has ordered a judicial inquiry by a sitting Judge of Orissa High Court under the commission of Inquiry Act, 1957 to the Monday's police firing incident at Kalinga Nagar industrial complex in Jajpur District where 15 tribal people including a police man killed sent a shock wave all over the state and the country. Panic stricken tribals belonging to three grampanchayats namely Baragadia, Gobarghatia and Chandia who lost 14 of their comrades nearer and dears who met with police bullet have choked the approaching road to Duburi and Kalinga Nagar by felling trees. Agitated tribals armed with lathis, arrows and bows are scrutinizing every body including press reporters fearing further police assault and another unprecedented firing. Trbals who have been the victim to state Govt's ill faceted R&R policy and proposed Displacement mechanism which bargained people since mega steel plants came to the area forcing them to accept the lower ever compensation packages, says a protester, guarding the NH-200,run through Paradeep and Duburi. When a team consisting of seven persons including two journalists visited Kalinga Nagar on the day following the brutal killing of more than 15 innocent tribals by police, the team witnessed calm and tensions every where; tribals are in up in arms to face any further eventuality. Though hordes of politicians and media persons rushed to the spot in a hurry locals were in no mode to talk to the visiting guests rather visiting jounos and politicians had to face the wrath of tribals which were against police and state government and ruling BJD-BJP alliance parties. Fear, shock, anger, tension prevailed every where, especially after Monday's incident and tribals seems to have organized more are in a mode to avenge the killings of their fellow villagers. During the last two days they have kept the dead bodies in the National Highway near the place of occurrence and are waiting more dead bodies to come after post mortem, " then only they will go for mass burial" said, Titusen Mohanta. Rumors making every where and tribals are suspecting that Police has dumped more lasses and has kept some of the injured tribals. "Still more than 30 tribals are reportedly missing" said, a villager of Kalamatia. However, the Chief Minister has described the police firing as an unfortunate incident and has ordered to pay compensation of Rs. 1 lakh each for relatives of those killed but tribals seems to be in no mode to receive these compensation money, stoutly denying this a tribal of chandia said "at one hand govt is killing innocent tribal in other way they are announcing the compensation package much to the dismay of us". Monday's firing followed the policemen's revenge to the November siege of Kaling Nagar Police Station by tribals protesting against the arrest of one Rabindra Jaraka, says, Subash Chandra Mohanta(25) a resident of Kalamatia village. A seventh class student who was returning to his home after procuring books and notebooks from the district headquarter town met with police bullets at Madhuban village nearest to the spot of incident. Police who fired indiscriminately to the protesters of proposed Tata steel project on 2 nd January killed more than 15 and injured 50 at Kalinga Nagar Mega Industrial estate proposed by Govt of Orissa. The Tribals mainly Santhals and Kudumis have been in war path with Govt and Steel Plants since May last were protesting on Monday against the construction of boundary wall of 15,400- crore six million MTPA Steel plant of Tatas' near Dholapathar village. Tisco, Jindal, Maharastra Seamless are among many more who are setting steel plants in 12,000 acre Kalinga Nagar industrial complex, although the government has acquired the plot in 1992 the land is still to be vacated and the tribals are agitating against poor compensation package and employment opportunity in the proposed projects. Opposition parties have announced to observe 7th of this month as state wide protest day called as Orissa Bandha describing the Monday's incident as another Jallianabag.
