The appellant, Anil Kumar, had asked for information under the Right to Information Act from the department of personnel and training (DoPT) regarding the appointment of MTNLs CMD. In August 2004, on the recommendation of the Public Enterprises Selection Board (PESB), the department of telecommunications (DoT) and DoPT proposed R S P Sinhas name as MTNL CMD to the Appointments Committee of Cabinet, which subsequently approved it. The appointment was challenged in September in the Delhi High Court by the Indian Telecom Service Association on the ground that PESB had arbitrarily changed the appointment criteria. In his appeal to CIC, Anil Kumar, who represents an NGO - Telecom Watchdog - alleged that Sinha is a man of doubtful integrity and substantive manipulative skills. He also alleged irregularities by officials in PSEB, DoT and DoPT in appointing Sinha. Against this backdrop, Kumar had asked for information regarding details of when the interview was conducted by PESB, whether PESB was shown Sinhas annual confidential report (ACR) by the administrative ministries concerned and if Sinhas ACR had adverse entries. That the first class general compartments of the Western Rail at peak evening hours were made the primary targets tells its own tale. (Mumbai has three major arterial rail services: Western, Central and Harbour. The Western one serves the most affluent demographic profile.) The perpetrators of such heinous crimes, and their masterminds, have to be identified and swiftly brought to book. It'd only make the task of the real criminals to cover their tracks far easier. It does not behove the BJP to charge that the 'soft' policy of the UPA government is responsible for a spurt in 'terrorism'. One must not forget that it is under their regime the Kargil war took place as they miserably failed to detect in time sizeable intrusion from across the LoC in Kashmir. It is under their regime, the Red Fort and the Indian Parliament House, and also the Kashmir Assembly came under armed assault. It is under their regime, the Akshaydham Temple in Gandhinagar - at the heart of "Killer" Modi land, became the site of a prolonged bloody gun battle. Only a sensible inclusive policy promoting a sense of belonging in all sections of Indian citizenry will lead to the isolation of the perpetrators of such bloody heinous crimes.
